Սահմանադրական դատարանը սահմանադրական հեղաշրջման մասնակի՞ց. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Նախօրեին մի քանի սահմանադրագետներ ահազանգ բարձրացրեցին այն առումով, որ «մթության քողի տակ» Նիկոլ Փաշինյանի Սահմանադրական դատարանը սեպտեմբերի 26-ի ՍԴՈ-1749 որոշմամբ փաստացի հրաժարվել է Անկախության հռչակագրի մի շարք սկզբունքներից, մասնավորապես՝ ՍԴ-ն ամրագրել է, որ ՀՀ-ն հրաժարվում է Արցախյան հարցից: Ի մասնավորի, սահմանադրագետ Գոհար Մելոյանը նշում է, որ ՍԴ այս որոշումը հակասահմանադրական է, քանի որ «Սահմանադրական դատարանն իրավասություն ՉՈՒՆԻ պաշտոնապես մեկնաբանելու Անկախության հռչակագիրը, կամ վերջինիս առանձին դրույթների գործողության կամ ուժի մեջ լինելու վերաբերյալ տալու եզրակացություն»։

Այսինքն, մեծամասամբ «փաշինյանական» դարձած Սահմանադրական դատարանն, ըստ էության, դրել է Նիկոլ Փաշինյանի ցանկության հիմքը, որը բխում է Ադրբեջանի պահանջներից, այն է՝ հրաժարվել Սահմանադրության մեջ Անկախության հռչակագրին հղումից, ինչը նշանակում է հրաժարվել Արցախի հարցից ու Ցեղասպանության պահանջատիրությունից: Թեման բավական ակտիվ քննարկման առարկա է դարձել, դրան անդրադարձել են մի շարք իրավաբաններ, նաև քաղաքական անհատ գործիչներ: Սակայն առավել կարևոր է, որ իրենց ձայնը բարձրացնեն ոչ միայն անհատները, այլև քաղաքական և հասարակական ուժերը՝ որպես միավորներ: Այս առումով, որպես «առաջին ծիծեռնակ» կարելի է դիտարկել «Հայաքվեի» երեկվա կոշտ հայտարարությունը:

«Սահմանադրական դատարանը, որը կոչված է ապահովելու սահմանադրական կարգ և կայունություն, Հայաստանի Հանրապետության սահմանադրաիրավական հիմքերի անսասանություն, այսպիսով գործող վարչախմբի պատվերով երկրում սահմանադրական հեղաշրջման մասնակիցն է դառնում»,-նշված է հայտարարության մեջ: «ՀայաՔվե» քաղաքացիական նախաձեռնության խորհուրդը հայտարարում է, որ «Սահմանադրական դատարանի սեպտեմբերի 26-ի ապօրինի որոշումը Հայաստանի Հանրապետությունում սահմանադրական կարգի տապալման, պետական իշխանության բոլոր ճյուղերի յուրացման հերթական վկայությունն է»։

Իր հերթին մեկ այլ սահմանադրագետ՝ Վահե Գրիգորյանը, Alpha News-ի հետ զրույցում շեշտել է, որ Սահմանադրական դատարանը չի կարող չեղարկել Անկախության հռչակագիրը: «Ուղղակի բացասական դարձած ավանդույթի համաձայն՝ Սահմանադրությունը հերթական անգամ մեկնաբանվել է տվյալ պահին գործող իշխանության քիմքին հարիր»,-ասել է նա:
