Հիմա արդեն ԲԴԽ-ն որոշել է, թե ինչ կարելի է անել կալանքի միջնորդություններ քննելիս, իսկ ինչը՝ ոչ. Հովհաննես Քոչարյան

Իրավաբան Հովհաննես Քոչարյանը ֆեյսբուքյան էջում գրառում է արել, որում ասվում է․

«Բարձրագույն դատական խորհրդի նախագահի պաշտոնակատարին էի լսում.

Խոսում էր ԲԴԽ-ի նախադեպային երկու որոշումներից: «Նախադեպային» բառը գրավեց ուշադրությունս ու ծանոթացա դրանցից մեկին՝ վերաքննիչ քրեական դատարանի դատավոր Լուսինե Աբգարյանի վերաբերյալ գործով հունիսի 7-ի որոշմանը: Այս որոշումը բառիս բուն իմաստով տրոցկիստական է: Այսպիսով, Բարձրագույն դատական խորհուրդը փաստացի ներմուծեց քրեական դատավարության իրավունքի մի նոր աղբյուր՝ բարձրագույն դատական խորհրդի իրավական դիրքորոշումները, որոնք չպահպանելու դեպքում դատավորը կանցնի «ԲԴԽ քավարանով»: Նշված որոշմամբ կալանքների վերաբերյալ Վճռաբեկ դատարանի իրավական դիրքորոշումները անխնա ռևիզիայի են ենթարկվել, որոնց արդյունքներով՝ կալանքի միջնորդությունները քննելիս դատավորների համար այլևս վտանգավոր կլինեն հետևյալ գործողությունների կատարումը.

- մեղադրանքի օրինականության ստուգումը. ԲԴԽ-ն բացարձակ չի կաշկանդվել ՀՀ սահմանադրական դատարանի ՍԴՈ-1453 որոշմամբ արտահայտած մեկնաբանություններով, համաձայն որի մեղադրանքի օրինականությունը պետք է ստուգվի նյութական և դատավարական լայն չափանիշներով: Օրինակ՝ դատարաններին չպետք է հուզի այն փաստը, որ մեղադրյալ ներգրավելու որոշումը կայացրել է ոչ պատշաճ, այսինքն, օրենքով չլիազորված սուբյեկտը կամ երբ այդ որոշումը կայացվել է առանց քրեական գործով կասեցված վարույթը վերսկսելու, կամ երբ մեղադրանքի առաջադրմանը ներկա չի գտնվել պաշտպանը և այլն:

- հիմնավոր կասկածը ստուգելիս մեղսագրվող արարքի քրեաիրավական որակման ճշտությանը որևէ կերպ անդրադառնալը: Կալանավորելու համար բավարար կլինի միայն այն, որ մեղսագրվող արարքը առերևույթ-մակերեսային նկարագրությամբ հանդիսանա քրեական օրենքով արգելված արարք և անձն էլ առնչություն ունենա այդ արարքի կատարման հետ: Այսինքն, կալանքի համար բավարար կլինեն նաև այն տեղեկությունները, որոնք կվկայեն ոչ թե անձի կողմից հանցանք կատարելու փաստի, այլև կատարման հնարավորության մասին: Ասենք, օրինակ, ռեալ հավաքվել են փաստական տվյալներ, որ անձը կատարել է կամ հնարավոր է կատարած լինի երկու անձանց սպանություն, բայց նախաքննության մարմինը որոշել է, որ կատարվածը գենոցիդ է: Ըստ ԲԴԽ-ի սառը մեկնաբանության՝ սա չպետք է հուզի դատարանին: Դատարանը պիտի կալանավորի անձին, էդ հետո, գործն ըստ էության քննելիս, կպարզվի՝ արարքը գենոցիդ էր, թե՝ սպանություն: Հանուն արդարության, պիտի ասեմ, որ այնպես չէ, որ դատարանները կալանքի միջնորդությունները քննելիս շեղվում էին ԲԴԽ-ի կողմից վերը հիշատակած կարմիր գծերից, բայց առանձին դատավորներ, այնուամենայնիվ, դրսևորում էին ճկունություն, համարձակություն և դատական ակտերում տալիս անձի ազատության ու անձեռնմխելիության իրավունքի առավել մեծ պաշտպանություն ապահովող մեկնաբանություններ՝ դատական համակարգին հաղորդելով անկախության ու ինքնուրույնության որակներ: Հիմա նման լոկալ ակտիվությունը կճնշվի և դատական համակարգը դե յուրե կդառնա պետական պատժիչ ապարատի մի մասնիկը՝ իր ձանձրալի ու ռիթմիկ աշխատանքով: Կանոնից շեղումներ չեն լինի կամ գրեթե չեն լինի: Բայց պետք է նաև արժանին մատուցել ԲԴԽ-ին: Այս որոշմամբ վեթինգին տրվեց իմաստ ու բովանդակություն, դատավորների համար կանխատեսելիություն, հիմա արդեն ԲԴԽ-ն որոշել է, թե ինչ կարելի է անել կալանքի միջնորդություններ քննելիս, իսկ ինչը՝ ոչ: Մի բան, որը այդպես էլ չհաջողվեց Վճռաբել դատարանին:
