Համապատասխանում է Սահմանադրությանը, թեև առանձին դրույթներ առերևույթ խնդրահարույց են, իսկ որոշ փոփոխություններ` վիճելի․ նախագահն ստորագրել է ՔԴՕ փոփոխությունների օրենսդրական փաթեթը

Հայաստանի Հանրապետության նախագահը հանդես է եկել հայտարարությամբ՝ կապված Քրեական դատավարության օրենսգրքի և կից օրենքների փաթեթի վերաբերյալ։ Հայտարարությունում ասվում է․

«Հայաստանի Հանրապետության քրեական դատավարության օրենսգիրքը (ՔԴՕ) և հարակից օրենքները` «Հայաստանի Հանրապետության քրեական դատավարության օրենսգրքում փոփոխություններ և լրացումներ կատարելու մասին» օրենքն (ՔԴՕ փոփոխություններ) ու «Բանկային գաղտնիքի մասին» օրենքում փոփոխություն կատարելու մասին» օրենքը (Բանկային գաղտնիքի մասին օրենք)` որպես օրենքների փաթեթ (այսուհետ՝ Օրենքների փաթեթ) Ազգային ժողովի կողմից Հանրապետության նախագահի ստորագրմանն են ներկայացվել 2021 թվականի հուլիսի 7-ին:

Բարեխիղճ իրավական մշակույթը ենթադրում է, որ փաթեթով ներկայացված օրենքները պետք է առնվազն լինեն տրամաբանորեն և կարգավորման առարկայով փոխկապակցված, հարակից օրենքների ընդունումը պետք է պայմանավորված լինի հիմնական օրենքի ընդունմամբ: Այսպիսով, պարզ չէ, թե ինչ նպատակով կամ ինչ տրամաբանությամբ է օրենսդիրը համարել ՔԴՕ-ն փոխկապակցված Օրենքների փաթեթում ներառված մյուս երկու օրենքների հետ` ներկայացնելով վերոնշյալ օրենքները փաթեթով:

Անհրաժեշտ է նշել, որ Ազգային ժողովի կողմից 2020 թվականի հունվարի 22-ին ընդունվեցին քրեական գործերի շրջանակում բանկային և ապահովագրական գաղտնիք կազմող, ինչպես նաև արժեթղթերի հետ կատարված գործարքների վերաբերյալ ծառայողական տեղեկությունների բացահայտման ընթացակարգը վերանայող օրենքներ, որոնց սահմանադրականությունը վիճարկվեց Հանրապետության նախագահի կողմից 2020 թվականի փետրվարի 6-ին: Բարձր դատարանը տվյալ հարցով որոշումն ընդունեց 2020 թվականի հունիսի 18-ին` ճանաչելով վիճարկված դրույթները Սահմանադրության մի շարք հոդվածներին հակասող: Օրենքների փաթեթով Հանրապետության նախագահի ստորագրմանը ներկայացված ՔԴՕ փոփոխություններն ու Բանկային գաղտնիքի մասին օրենքը` համեմատած 2020 թվականի հունվարի 22-ին ընդունված տեքստի, զգալիորեն փոփոխվել են` մոտարկվելով Սահմանադրությանը, այնուամենայնիվ առանձին կարգավորումներ առերևույթ խնդրահարույց են համաչափության սկզբունքի տեսանկյունից:

Ինչ վերաբերում է ՔԴՕ-ին, ապա Հանրապետության նախագահի աշխատակազմի կողմից բազմաթիվ հայեցակարգային փոփոխություններ նախատեսող այդ ծավալուն փաստաթղթի նախնական ուսումնասիրությունը թույլ է տալիս գալ եզրահանգման, որ այն ընդհանուր առմամբ համապատասխանում է Սահմանադրությանը, սակայն դրա առանձին դրույթներ առերևույթ խնդրահարույց են, իսկ որոշ փոփոխություններ` հայեցակարգային առումով վիճելի և իրավակիրառ պրակտիկայի տեսանկյունից մարդու իրավունքների պաշտպանության համատեքստում գործնական ռիսկեր պարունակող:
