Վճռաբեկ դատարանը ոչ իրավաչափ է ճանաչել Ալեն Սիմոնյանի եղբոր կնոջ կալանավորումը

Հակակոռուպցիոն դատարանի դատավոր Մերի Մոսինյանը 2024 թվականի փետրվարի 1-ին ՀՀ ԱԺ նախագահ Ալեն Սիմոնյանի եղբոր կնոջը՝ Անի Գևորգյանին կալանավորելու որոշում էր կայացրել՝ ՀՀ Էկոնոմիկայի նախարարությանն առնչվող քրեական գործի շրջանակում։ 

«Արմենպրես»-ի փոխանցմամբ՝ Վճռաբեկ դատարանը, սակայն, ուսումնասիրելով նյութերը, որոշել է, որ այդ որոշումը եղել է ոչ իրավաչափ ու այն կայացնելիս հաշվի չեն առնվել մի շարք էական հանգամանքներ։ 

Մասնավորապես, Վճռաբեկ դատարանն արձանագրել է, որ ստորադաս դատարաններն Անի Գևորգյանի կողմից քրեական վարույթին խոչընդոտելու հավանականությունը գնահատելիս՝ սխալ են գնահատել վարույթի նյութերում առկա փաստական տվյալները։ Գևորգյանի կողմից ոչ պատշաճ վարքագիծ դրսևորելու և քրեական դատավարության բնականոն ընթացքը խոչընդոտելու հավանականության աստիճանը գնահատելիս՝ հաշվի չի առնվել, որ Անի Գևորգյանն այդ մեղադրանքում ներկայացված իրադարձությունների ընթացքում արդեն ազատված է եղել «Սիներջի» ընկերությունում իր աշխատանքից և այլևս չի հանդիսանում այդ կազմակերպության աշխատակից, ինչն ինքնին նվազեցնում է վերջինիս կողմից քրեական վարույթին խոչընդոտելու հավանականության աստիճանը։ 

Միևնույն ժամանակ Վճռաբեկ դատարանը գտել է, որ ստորադաս դատարաններն Անի Գևորգյանի նկատմամբ կալանքը որպես խափանման միջոց կիրառելու իրավաչափությունը քննարկելիս՝ պատշաճ ուշադրության չեն արժանացրել այն հանգամանքը, որ Գևորգյանի խնամքին է գտնվում երկու մանկահասակ երեխա։ 

Նման պայմաններում ստորադաս դատարանները, խախտելով ՀՀ քրեական դատավարության օրենսգրքի 18-րդ հոդվածի 2-րդ մասով սահմանված կանոնը, Գևորգյանի նկատմամբ հարկադրանքի միջոց ընտրելիս՝ չեն առաջնորդվել նվազագույնի սկզբունքով ու պատշաճ քննարկման առարկա չեն դարձրել քրեական վարույթի ընթացքում անձի օրինական վարքագիծն ապահովելու նպատակով այլընտրանքային խափանման միջոցների կիրառման հնարավորությունը։

Ամփոփելով վերոգրյալը՝ Վճռաբեկ դատարանն արձանագրել է, որ Ալեն Սիմոնյանի եղբոր կնոջ՝ Անի Գևորգյանի նկատմամբ կալանքը որպես խափանման միջոց կիրառելու իրավաչափության մասին ստորադաս դատարանների հետևություններն իրավաչափ չեն։
