2024 թվականի առաջին կիսամյակի ընթացքում անչափահասի նկատմամբ բռնի սեռական գործողությունների դեպքերով հարուցվել է 7 քրեական գործ

2024 թվականի 1-ին կիսամյակի ընթացքում սեռական ազատության և սեռական անձեռնմխելիության դեմ ուղղված հանցագործությունների դեպքերի առթիվ քննված վարույթներից 16-ն ավարտվել է մեղադրական եզրակացությամբ և ուղարկվել դատարան, որոնցից 4-ը կատարվել է ընտանիքի անդամի կողմից:

Այս մասին, ի պատասխան Tert.am-ի գրավոր հարցմանը, տեղեկացրել են Քննչական կոմիտեից:

«Նշված 16 քրեական վարույթով, մինչև 16 տարեկան 18 անչափահաս ճանաչվել է տուժող: 9 քրեական վարույթ կարճվել է, որոնցից որևէ մեկը կատարված չի եղել ընտանիքի անդամի կողմից: Նշված 9 քրեական վարույթով մինչև 16 տարեկան 6 անչափահաս ճանաչվել է տուժող»,- ասված է ՔԿ-ի պատասխանում:

Tert.am-ը ՔԿ-ից մասնավորապես հետաքրքրվել էր 16 տարեկանը չլրացած անձանց նկատմամբ սեռական բնույթի քանի դեպք է ՔԿ-ում ստացվել 2024-ին:

Tert.am-ը պարզելու համար, թե անչափահասների նկատմամբ սեռական բռնի գործողությունների դեպքերով քանի՞ դատական գործ կա հարուցված, ի՞նչ վճիռներ կան կամ հաշտության քանի՞ դեպք կա գրավոր հարցմամբ դիմել էր Դատական դեպարտամենտ:

Դատական դեպարտամենտից Tert.am-ին տեղեկացրել են՝ ըստ 2024թ. առաջին կիսամյակի հրապարակված վիճակագրական տվյալների՝ ՀՀ առաջին ատյանի ընդհանուր իրավասության դատարաններում ՀՀ քրեական օրենսգրքի 200-րդ հոդվածով՝ «Սեքսուալ բնույթի գործողություններ կատարելը 16 տարին չլրացած անձի նկատմամբ» նախատեսված արարք կատարելու համար մեղադրվող անձանց վերաբերյալ ստացվել է թվով 7 քրեական գործ, որոնցով կայացվել են 4 վերջնական դատական ակտեր (1-ը՝ 2024 թվականին ստացված քրեական գործերով):

«Դրանցից 3 քրեական գործերով կայացվել է մեղադրական դատավճիռ և որպես պատիժ նշանակվել է ազատազրկում, իսկ 1-ով՝ հարուցված քրեական հետապնդումը դադարեցվել է՝ մեղադրյալի և տուժողի հաշտության հիմքով (2024 թվականին ստացված քրեական գործերով)»,- ասված է  դատական դեպարտամենտի պատասխանում:

Ինչ վերաբերում է անչափահասների թրաֆիքինգի վերաբերյալ գործեր քննվե՞լ են հարցին, Դեպարտամենտից տեղեկացրել են. «Ըստ 2024թ. առաջին կիսամյակի հրապարակված վիճակագրական տվյալների՝ ՀՀ քրեական օրենսգրքի 189-րդ հոդվածով՝ «Երեխայի կամ անօգնական վիճակում գտնվողի թրաֆիքինգը կամ շահագործումը» նախատեսված արարք կատարելու համար մեղադրվող անձանց վերաբերյալ ՀՀ առաջին ատյանի ընդհանուր իրավասության դատարաններում ստացվել են երկու քրեական գործ»:
