37 փաթեթ թմրամիջոց իրացնելու համար 2 անձ է կալանավորվել

ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչության Էրեբունի և Նուբարաշեն վարչական շրջանների քննչական բաժնում քննվող քրեական վարույթի շրջանակում բացահայտվել է իրացման նպատակով առանձնապես խոշոր չափերով թմրամիջոցների ապօրինի շրջանառության հերթական դեպքը։

2024 թվականի նոյեմբերի 24-ին Էրեբունի վարչական շրջանի Արին-Բերդ փողոցում կայանված Վազ 21214 մակնիշի ավտոմեքենայի կողքին կպչուն ժապավենով փաթեթներ նկատելու հանգամանքով պայմանավորված, ապօրինի թմրամիջոց պահելու և իրացնելու կասկածանքով, պարեկային ծառայողների կողմից ՆԳՆ ոստիկանության Նուբարաշենի բաժին են տեղափոխվել նշված տրանսպորտային միջոցի վարորդը և ուղևորը։ Վերջիններս իրավապահներին հայտնել են իրենց կողմից շահագործվող ավտոմեքենայում ևս թմրանյութերի առկայության մասին։

Դեպքի առթիվ ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչության Էրեբունի և Նուբարաշեն վարչական շրջանների քննչական բաժնում նախաձեռնվել է քրեական վարույթ՝ ՀՀ քրեական օրենսգրքի 393-րդ հոդվածի 2-րդ մասի 1-ին և 2-րդ կետերով։

Իրականացված անհրաժեշտ միջոցառումներով պարզվել է ոստիկանության բաժին տեղափոխված հիշյալ անձանց ինքնությունը։ Վերջիններս, անմիջականորեն ծագած հիմնավոր կասկածի հիմքով, ձերբակալվել են և հարցաքննվել:

Նախաքննության ընթացքում կատարվել է դեպքի վայրի զննություն, որի ընթացքում հայտնաբերվել է գետնին նետված ընդհանուր թվով 12 փաթեթ, իսկ Վազ 21214 մակնիշի ավտոմեքենայի խուզարկությամբ հայտնաբերվել է կպչուն ժապավեններով փաթեթավորված ընդհանուր 25 մանր փաթեթ։

Հայտնաբերված զանգվածների քաշը և բաղադրությունը պարզելու նպատակով նշանակվել է դատաքիմիական և դատաբուսաբանական համալիր փորձաքննություն:

Փորձագետի եզրակացության համաձայն՝ փաթեթներից վերցված նմուշը հանդիսանում է «Մեֆեդրոն»  տեսակի թմրամիջոց։

Ձերբակալվածների անձնական խուզարկությամբ հայտնաբերված բջջային հեռախոսում կատարվել է թվային խուզարկություն, որի արդյունքում պարզվել է, որ Արին-Բերդ փողոցի տարբեր հատվածներում բջջային հեռախոսով կատարվել է  11 տեղանքի լուսանկարում, որոնց վրա գրված են եղել կոորդինատներ։

Ձեռք բերված բավարար փաստերի հիման վրա վերոհիշյալ անձանց նկատմամբ հարուցվել է հանրային քրեական հետապնդում՝ ՀՀ քրեական օրենսգրքի 44-393-րդ հոդվածի 3-րդ մասի 2-րդ կետի հատկանիշներով, և նրանց մեղադրանք է ներկայացվել։

Միջնորդություններ են ներկայացվել դատարան՝ վերջիններիս նկատմամբ որպես խափանման միջոց կալանք կիրառելու վերաբերյալ, որոնք բավարարվել են։

Նախաքննությունը շարունակվում է:

Ձեռնարկվում են միջոցառումներ՝ թմրամիջոցների ապօրինի շրջանառության շղթայում հնարավոր այլ անձանց առկայությունը, ինչպես նաև՝ թմրամիջոցի ձեռք բերման աղբյուրը պարզելու ուղղությամբ:

Ոստիկանության համապատասխան ստորաբաժանմանը տրվել են հանձնարարություններ:

Ծանուցում. Հանցանքի համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով դատարանի` օրինական ուժի մեջ մտած դատավճռով:
