ՀՀ քննչական կոմիտեն տեղեկացրել է, որ 2024 թ․ ապրիլի 12-ին ՀՀ ՊՆ հաշվեկշռում գտնվող «Ուրալ» մակնիշի ավտոմեքենայի վթարման, դրա հետևանքով 4 զինծառայողների մահվան և մի շարք զինծառայողների տարբեր աստիճանների վնասվածքներ ստանալու դեպքի առթիվ ՀՀ քննչական կոմիտեի զինվորական քննչական գլխավոր վարչության 9-րդ կայազորային քննչական բաժնում ՀՀ քրեական օրենսգրքի 538-րդ հոդվածի 4-րդ մասի (Մարտական, հատուկ կամ տրանսպորտային մեքենա վարելու կամ շահագործելու կանոն խախտելը, որն անզգուշությամբ առաջացրել է երկու կամ ավելի անձանց մահ) հատկանիշներով նախաձեռնվել է քրեական վարույթ։

Նշված քրեական վարույթով նախաքննությունը շարունակվում է, ողբերգական ելքով դեպքի ամբողջական հանգամանքները պարզելու ուղղությամբ իրականացվում են մեծածավալ քննչական և վարութային գործողություններ։

Մասնավորապես առգրավվել են ավտոմեքենայի շահագործման պահանջներին, տրանսպորտային միջոցի տեխնիկական ընդհանուր վիճակին, շահագործելիությանը վերաբերող անհրաժեշտ բոլոր փաստաթղթերը։

Հարցաքննվել են երկու տասնյակից ավելի անձինք՝ ինչպես զինծառայողներ, այնպես էլ հրամանատարական կազմի ներկայացուցիչներ, զորամասի տրանսպորտային միջոցների անվտանգության և պահպանության համար պատասխանատուներ։ Նշանակվել են փորձաքննություններ։

Այս պահի դրությամբ, քննչական անհրաժեշտ գործողություններ դեռևս հնարավոր չի եղել իրականացնել ավտոմեքենայի վարորդի, ինչպես նաև նրան ուղեկցող՝ շահագործման պատասխանատուի՝ ավտոմեքենայի ավագի հետ՝ վերջիններիս առողջական վիճակով պայմանավորված։

Հաշվի առնելով առկա շահարկումները, անհրաժեշտ ենք համարում տեղեկացնել, որ նախաքննությամբ հերքվել է տվյալ միջադեպը որևէ կրակոցի հետ պայմանավորված լինելու հանգամանքը։ Ըստ քննությամբ ձեռք բերված տվյալների՝ զինծառայողի կողմից ավտոմեքենան վարելը եղել է իրավաչափ, ավտոմեքենայի շահագործումը տվյալ անձին վստահելու հետ կապված անհրաժեշտ ընթացակարգերը, առկա փաստական տվյալներով, ապահովված են եղել։      

Նախաքննությունը շարունակում է։ Քննություն է իրականացվում շահագործման համար ավտոմեքենայի կամ դրա դետալների պիտանելիության և շահագործելիության, զինծառայողների փոխադրումը սահմանված պահանջներին և կանոններին համապատասխան իրականացվելու հանգամանքները, ինչպես նաև բուն վթարի առաջացմանը նպաստած օբյեկտիվ և սուբյեկտիվ գործոնները պարզելու ուղղությամբ։

Քննության արդյունքները, թույլատրելիության սահմաններում, ՀՀ քննչական կոմիտեն հընթացս կներկայացնի հանրությանը։

Ծանուցում. Հանցանքի համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով, դատարանի` օրինական ուժի մեջ մտած դատավճռով:
