Տուժող 91 անչափահասներից 35-ը եղել է մինչև 12 տարեկան․ ՔԿ-ն մանրամասնում է

ՀՀ քննչական կոմիտեն ամոփոփել է նախորդ տարի անչափահասների նկատմամբ կատարված հանցագործությունների ընդհանուր քրեաիրավական շարժընթացը։

Ըստ այդմ, 2023թ․-ին Կոմիտեի վարույթում քննվել է անչափահասների նկատմամբ կատարված հանցագործությունների վերաբերյալ 1159 քրեական վարույթ՝ նախորդող տարվա 545 վարույթի դիմաց։ Այսպիսով մեկ տարվա ընթացքում արձանագրվել է վերոնշյալ հանցագործությունների կամ նման առերևութ հանցածին տարրեր պարունակող դեպքերի շուրջ 112 տոկոս աճ։

Դրան զուգահեռ ավելացել է նաև դատարան ուղարկված վարույթների քանակը։ Այսպես․ 2023թ․-ին նախաձեռնված 1159 քրեական վարույթից 78-ն ավարտվել է մեղադրական եզրակացությամբ և 82 անձի վերաբերյալ ուղարկվել դատարան (2022-ին դատարան ուղարկված վարույթները եղել են 66-ը՝ 73 անձի վերաբերյալ)։

Դատարան ուղարկված վարույթներով հիշյալ 82 մեղադրյալներից 29-ը կամ 35%-ը հանդիսացել են անչափահաս տուժողի ընտանիքի անդամներ, 2-ը՝ խնամակալ, հոգաբարձու, 1-ը՝ բժշկական հաստատության աշխատակից։ Մնացած հանցագործությունները կատարվել են այլ անձանց կողմից:

Դատարան ուղարկված վարույթներից՝

• 1-ը քննվել է սպանության,

• 7-ը՝ առողջությանը տարբեր աստիճանի վնասներ պատճառելու,

• 4-ը՝ մարդուն առևանգելու,

• 1-ը՝ ազատությունից ապօրինի զրկելու,

• 10-ը՝ ֆիզիկական ներգործության,

• 14-ը՝ սեքսուալ բնույթի գործողությունների,

• 1-ը՝ խնամքը ստանձնելու նպատակով երեխայի առքի կամ ստանձնողի խնամքին հանձնելու նպատակով երեխայի վաճառքի,

• 40-ը՝ այլ հանցագործությունների դեպքերի առթիվ:

Դատարան ուղարկված վարույթներով տուժող է ճանաչվել 91 անչափահաս։ Նրանցից՝

• 35-ը եղել են մինչև 12 տարեկան,

• 17-ը՝ 12-ից 14 տարեկան,

• 19-ը՝ 14-ից 16 տարեկան,

• 20-ը՝ 16-ից 18 տարեկան:

2023թ․ ընթացքում քննված 522 քրեական վարույթ կարճվել է, որից 450-ը` ռեաբիլիտացնող, 71-ը` ոչ ռեաբիլիտացնող, 1-ը՝ այլ հիմքով։151-ով ավարտվել են վարութային և ապացուցողական գործողությունները, 9 քրեական վարույթ ուղարկվել է ըստ ենթակայության, 36-ը` միացվել է։ 363 վարույթի քննությունը տեղափոխվել է 2024 թվական:

Երեխայի օրինական շահերի քրեաիրավական պաշտպանությունը ՀՀ քննչական կոմիտեի բացարձակ առաջնայնություններից է։ Անչափահասների նկատմամբ կատարված հանցագործությունների անաչառ և համակողմանի քննությունը, նաև նրանց նկատմամբ հանցավոր ոտնձգությունների կանխման համատեքստում, մշտապես գտնվում է Կոմիտեի ուշադրության կենտրոնում։
