Քննչական կոմիտեի քննիչը հայտարարագիր չի ներկայացրել, նրան մեղադրանք է ներկայացվել․ Դատախազություն

ՀՀ հակակոռուպցիոն կոմիտեում քննվող քրեական վարույթի շրջանակներում հիմնավորվել է, որ ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչության Երևան քաղաքի Արաբկիր վարչական շրջանի քննչական բաժնի նախկին քննիչ Վ.Գ.-ն նշված պաշտոնում աշխատելու ժամանակահատվածում «Հանրային ծառայության մասին» ՀՀ օրենքի 34-րդ հոդվածով սահմանված կարգով հանդիսացել է հայտարարագիր ներկայացնելու պարտականություն ունեցող անձ:

 Այս մասին հայտնում է ՀՀ գլխավոր դատախազությունը։

Ի թիվս այլնի՝ նա պարտականություն է ունեցել նաև ներկայացնել պաշտոնեական պարտականությունները դադարեցնելու հայտարարագիր: Մինչդեռ 2020թ. հուլիսի 29-ին ազատվելով պաշտոնից՝ Վ. Գ.-ն սահմանված ժամկետում՝ 30 օրվա ընթացքում, ՀՀ կոռուպցիայի կանխարգելման հանձնաժողով չի ներկայացրել 2020թ. պաշտոնեական պարտականությունները դադարեցնելու հայտարարագիրը:

Վերջինս հայտարարագիրը չի ներկայացրել նաև հետագայում Հանձնաժողովի կողմից համապատասխան ծանուցում ստանալուց հետո, ինչի արդյունքում 2021թ. սեպտեմբերի 02-ին Հանձնաժողովը որոշել է հայտարարագիրը սահմանված ժամկետում չներկայացնելու համար Վ. Գ.-ի նկատմամբ կիրառել վարչական տույժ՝ սահմանված նվազագույն աշխատավարձի երկուհարյուրապատիկի չափով:

 Մինչդեռ վերջինս պատշաճ ծանուցված լինելով վարչական տույժի կիրառման մասին՝ դրանից հետո էլ սահմանված 30 օրվա ընթացքում դիտավորությամբ չի ներկայացրել 2020թ. պաշտոնեական պարտականությունները դադարեցնելու օրվա դրությամբ առկա գույքի և եկամուտների հայտարարագիր:

 Ելնելով քրեական վարույթի շրջանակներում ձեռք բերված ապացույցներից՝ վարույթի օրինականության նկատմամբ հսկողություն իրականացնող դատախազի որոշմամբ Վ. Գ.-ի նկատմամբ հարուցվել է քրեական հետապնդում արարքը կատարելու պահին գործող ՀՀ քրեական օրենսգրքի 314.2-րդ հոդվածի 1-ին մասով (որը համապատասխանում է գործող ՀՀ քրեական օրենսգրքի 444-րդ հոդվածի 1-ին մասին): Դրա հիման վրա վարույթն իրականացնող մարմնի կողմից վերոնշյալ հոդվածով նրան առաջադրվել է մեղադրանք:

 Քրեական վարույթի նախաքննությունն ավարտվել է: Դատախազը հաստատել է մեղադրական եզրակացությունը և վարույթի նյութերի հետ ուղարկել է ՀՀ հակակոռուպցիոն դատարան՝ ըստ էության քննելու:

 Գույքի և եկամուտների հայտարարագիրը դիտավորությամբ չներկայացնելու արարքի քրեականացումից ի վեր սա նման հանցակազմով դատարան ուղարկված երկրորդ քրեական գործն է:

 Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
