Մարդու իրավունքների պաշտպանի դիրքորոշումը ՀՀ Գլխավոր դատախազի կողմից Սահմանադրական բարեփոխումների հանձնաժողովին ուղղված՝ պետական դավաճանություն կատարելու համար մահապատժի ենթարկելու սահմանադրաիրավական հիմքեր ստեղծելու առաջարկի կապակցությամբ

Արձագանքելով տարբեր հարցումներին, տեղեկացնում ենք, որ Մարդու իրավունքների պաշտպանը ևս մտահոգիչ է համարում 44-օրյա պատերազմի ընթացքում և դրանից հետո արձանագրված առերևույթ պետության անվտանգության դեմ ուղղված հանցագործությունների առկայությունը, դրանց քանակը և իհարկե, ենթադրյալ հանցավոր արարքների դրսևորման եղանակները։ Միևնույն ժամանակ Մարդու իրավունքների պաշտպանը գտնում է, որ նման դեպքերը բացառելու նպատակով անհրաժեշտ է տանել առավել արդյունավետ կանխարգելիչ աշխատանքներ, այդ թվում՝ ենթադրյալ հանցավոր արարքների նախականխման և կանխման համապատասխան միջոցառումներ։ Այլ կերպ ասած, իրավապահ մարմինների, այդ թվում՝ օպերատիվ հետախուզական և հակահետախուզական գործունեություն իրականացնող մարմինների աշխատանքի արդյունավետությունն էլ ավելի բարձրացնելու լուծումները չպետք է փնտրել Սահմանադրությամբ ամրագրված մարդու իրավունքների և ազատությունների և սահմանադրական արժեքների նվազեցման մեջ։

Բացի այդ, անհերքելի ճշմարտություն է նաև այն, որ քրեական քաղաքականության ընդհանուր կանխարգելիչ ֆունկցիայի արդյունավետությունը պայմանավորված է ոչ միայն և ոչ այնքան հանցավոր արարքի համար նախատեսված պատժի խստությամբ, որքան հանցավոր արարքի համար պատժի անխուսափելիության ապահովմամբ։ Հետևաբար Պաշտպանի գնահատմամբ, պետության քրեական քաղաքականությունը հատկապես պետության անվտանգության դեմ ուղղված հանցագործություններով, այդ թվում՝ պետական դավաճանության պարագայում, պետք է գնա հնարավոր հանցավոր արարքների նախականխմանը, կանխմանը կամ խափանմանն ուղղված գործողությունների արդյունավետության բարձրացման և կատարված հանցագործությունների դեպքում պատժի անխուսափելիությունն ապահովելու ճանապարհով։

Մարդու իրավունքների պաշտպանը նաև որպես Սահմանադրական բարեփոխումների խորհրդի անդամ, նման առաջարկի քննարկումն անգամ տեղին չի համարում, քանի որ այն մեծապես ստվերում է կյանքի իրավունքի և ընդհանրապես մարդու իրավունքների պաշտպանության սահմանադրական ու ժողովրդավարական արժեքները։
