Դիրքի ավագը սեքսուալ գործողություն է կատարել զինվորի նկատմամբ․ 3 սպանվածի գործով մանրամասներ կան

ՀՀ քննչական կոմիտեի զինվորական քննչական գլխավոր վարչությունում իրականացված մեծածավալ քննչական և դատավարական գործողությունների արդյունքում պարզվել են 2021թ. օգոստոսի 19-ին երեք զինծառայողի սպանության դեպքի՝ էական նշանակություն ունեցող հանգամանքները, այդ թվում՝ շարժառիթը:

Ավելի վաղ տեղեկացրել էինք, որ նշված օրը, պարտադիր ժամկետային երեք զինծառայողների դիերը, հրազենային մահացու վնասվածքներով, հայտնաբերվել էին ՀՀ ՊՆ զորամասերից մեկի մարտական դիրքի կացարանում:

Նախաքննության ընթացքում փաստական տվյալներ են ձեռք բերվել այն մասին, որ պարտադիր ժամկետային զինծառայողներից մեկը գումար է պարտք եղել դիրքի ավագին, որը վերջինս մի քանի օր անց պահանջել է, ինչին ծառայակիցը պատասխանել է, որ կարող է վերադարձնել մարտական հերթապահության ավարտից հետո: Որոշ ժամանակ անց դիրքի ավագը ծառայակցից պահանջել է մի քանի անգամ ավելի գումար, քան վերջինիս ունեցած պարտքն է եղել:

Պարզվել է նաև, որ ավագը դիրքի կացարանում սեքսուալ բնույթի՝ համասեռական գործողություններ է կատարել նշված ծառայակցի նկատմամբ, ինչը տեսել է մեկ այլ ծառայակից և պատմել իր երկու համածառայակիցներին, ովքեր սկսել են ծաղրել: Տեղի ունեցածը չհանրայնացնելու և իր բարի համբավը չարատավորվելու մղումներից դրդված՝ դիրքի ավագը պարբերաբար սպառնացել  է ծառայակցին, որ իրենց միջև տեղի ունեցածի վերաբերյալ կհայտնի վերջինիս ծնողներին, եթե նշված երեք ծառայակիցներին չսպանի:

2021թ. օգոստոսի 19-ին՝ ժամը 01:30-ի սահմաններում, ծառայողը, ստանձնելով արթուն հերթափոխի պարտականությունները, երեք ծառայակիցներին ապօրինաբար կյանքից զրկելու դիտավորությամբ, մտել է մարտական դիրքի կացարան, վերցրել ծառայակիցներից մեկին ամրակցված ԱԿ-74 տեսակի ինքնաձիգը, տեղադրել փամփշտատուփը, լիցքավորել այն և համածառայիկցներին սպանելու ուղղակի դիտավորությամբ՝ կրակոցներ արձակել քնած վիճակում գտնվող համածառայակիցների ուղղությամբ՝ նրանց պատճառելով կյանքի հետ անհամատեղելի մահացու հրազենային վնասվածքներ և դուրս եկել կացարանից:

Ձեռք բերված բավարար ապացույցների համակցությամբ պարտադիր ժամկետային զինծառայողին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 104-րդ հոդվածի 2-րդ մասի 1-ին կետով, իսկ դիրքի ավագին՝ ՀՀ քրեական օրենսգրքի 139-րդ հոդվածի 1-ին մասի 8-րդ կետով և 38-104-րդ հոդվածի 2-րդ մասի 1-ին կետով: Նրանց նկատմամբ որպես խափանման միջոց կիրառվել է կալանավորումը:

Նախաքննությունն ավարտվել է, և քրեական գործը, մեղադրական եզրակացությունը հաստատելու և դատարան ուղարկելու միջնորդությամբ, ուղարկվել է դատավարական ղեկավարում իրականացնող դատախազին: 

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ,քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
