Բացահայտվել են պաշտոնատար անձին կաշառք տալու պատրվակով խարդախությամբ գումար հափշտակելու դեպքեր

ՀՀ հակակոռուպցիոն կոմիտեում քննված քրեական գործի նախաքննությամբ ձեռք  բերված բավարար ապացույցների համակցությամբ հիմնավորվել է, որ Ս. Ա.-ն վարորդական վկայականներ ձեռք բերելու համար Ա. Ա.-ի դրդմամբ փորձել  է ընդհանուր 270.000 ՀՀ դրամ կաշառք տալ ոստիկանության պաշտոնատար անձին, սակայն իր կամքից անկախ հանգամանքներով պայմանավորված՝ հանցագործություններն ավարտին չի հասցրել:

Ինչպես հայտնում են Հակակոռուպցիոն կոմիտեից, Ա. Ա.-ն, հանդիպելով իր ծանոթ Ս. Ա.-ին, վերջինիս խաբեությամբ վստահեցրել է, որ ոստիկանության աշխատակիցներից մեկի միջոցով, 150.000 ՀՀ դրամ կաշառքի դիմաց, առանց տեսական ու գործնական քննություններ հանձնելու կարող է կազմակերպել վարորդական վկայական ձեռք բերելու գործընթաց։ Ս. Ա.-ն, ընդունելով առաջարկը, իր ծանոթի որդու համար վարորդական վկայական ձեռք բերելու համար 2022 թվականի փետրվարին Ա. Ա.-ին փոխանցել է 150.000 ՀՀ դրամ՝ ոստիկանության պաշտոնատար անձին որպես կաշառք տալու համար։

Այնուհետև, Ա. Ա.-ն Ս. Ա.-ին վստահեցրել է, որ նրա ներկայացրած անձին վարորդական վկայական տրամադրելու համար անհրաժեշտ է ոստիկանության պաշտոնատար անձի միջոցով, 120.000 ՀՀ դրամ կաշառքի դիմաց ևս մեկ անձի կողմից վարորդական վկայական ստանալու գործընթաց կազմակերպել: Այդ կերպ Ա. Ա.-ն համոզելու եղանակով դրդել է Ս. Ա.-ին կրկին կաշառք տալ պաշտոնատար անձին: Ս. Ա.-ն, այս անգամ իր եղբոր որդու համար առանց տեսական և գործնական քննություններ հանձնելու վարորդական վկայական ձեռք բերելու համար, 2022 թվականի մարտին 120.000 ՀՀ դրամ է փոխանցել Ա. Ա.-ին` ոստիկանության պաշտոնատար անձին որպես կաշառք տալու համար:

Ստանալով վերը նշված գումարները` Ա. Ա.-ն, նախապես գիտակցելով իր խոստումը կատարելու անհնարինությունը և չունենալով որևէ մեկին կաշառք տալու կամ դրա դիմաց վարորդական վկայական ստանալու նպատակ, խաբեությամբ հափշտակել է ընդհանուր 270.000 ՀՀ դրամ, ինչի պատճառով Ս. Ա.-ն իր կամքից անկախ հանգամանքներով չի կարողացել հանցագործություններն ավարտին հասցնել:

Վերը նշված հանցավոր արարքների համար Ա. Ա.-ին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 38-34-312-րդ հոդվածի 1-ին մասով (2 դրվագ), իսկ Ս. Ա.-ին մեղադրանք է առաջադրվել 34-312-րդ հոդվածի 1-ին մասով (2 դրվագ): Երկու մեղադրյալներն էլ առաջադրված մեղադրանքներում իրենց մեղավոր են ճանաչել և տվել խոստովանական ցուցմունքներ:

Քրեական գործի նախաքննությունն ավարտվել է: Գործը մեղադրական եզրակացությամբ հաստատվել է հսկողություն իրականացնող դատախազի կողմից և ուղարկվել դատարան:

Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
