Եթե Փաշինյանը Ռոբերտ Քոչարյանի գործողության համար պատժվեր, Ավետիք Չալաբյանի նկատմամբ այդպիսի լկտիություն իրեն թույլ չէր տա

Օրերս դատավոր Արմեն Շիրոյանը հասարակական գործիչ Ավետիք Չալաբյանի խափանման միջոցը փոփոխելու համար ներկայացված միջնորդությունների քննության նիստը հետաձգեց՝ նշանակելով հուլիսի 21-ին:

Չալաբյանի երկամսյա կալանքի ժամկետը լրանում է հուլիսի 12-ին, վերջինիս փաստաբանական խումբը պնդում է՝ հուլիսի 1-ից ուժի մեջ մտնող նոր քրեական օրենսգրքով այն հոդվածը, որով մեղադրանք է առաջադրվել Չալաբյանին, այլևս չի գործելու, բայց իշխանություններն ամեն ինչ անում են՝ վերջինիս հնարավորինս երկար ժամանակով անազատության մեջ պահելու համար:

Որո՞նք են դրդապատճառները, ինչի՞ց են վախենում իշխանությունները, 1or.am-ը փորձել է պարզել Շիրակի պետական համալսարանի Կառավարման ամբիոնի դասախոս Արթուր Համբարձումյանի հետ զրույցում.

«Ընդունված է ասել, որ Ավետիք Չալաբյանը, Արմեն Գրիգորյանը և մյուսները քաղաքական բանտարկյալներ են: Ես կտրուկ համաձայն չեմ այս ձևակերպման հետ, որովհետև քաղաքական բանտարկյալ ունենալու համար նախ պետք է ունենալ քաղաքական իշխանություն, որը, քաղաքական նպատակահարմարությունից ելնելով, կալանավորում կամ կալանավորել է տալիս այս կամ այն մարդկանց: Հայաստանի Հանրապետությունում վաղուց չկա քաղաքական իշխանություն, և երկիրը քաոսի վերածվելուց փրկում է բյուրոկրատական համակարգը: Սա ոչ թե էմոցիոնալ քաղաքական պնդում է, այլ փաստերի ուղիղ արձանագրում: Հայաստանում քաղաքական վակուումը փորձում են լրացնել որոշակի ազդեցություն ունեցող քաղաքական խմբեր և այդ խմբերը ձերբակալել և կալանավորել են տալիս բոլոր այն մարդկանց, ում գործունեությունն այս պահին իրենց թվում են անհարմար: Այդ որոշումը կայացնելու վրա կարող են ազդել նաև այլ գործոններ: Օրինակ, Փաշինյանը կարող էր խմած լինել Չալաբյանի, Գրիգորյանի կամ մեկ այլ մարդու խոսքը լսելիս և այդպիսի հրահանգ տալ իր իրավապահ համակարգի ներկայացուցիչներին: 

Համբարձումյանի խոսքով՝ Փաշինյանը մարդկանց կալանավորելն օգտագործում է որպես պատժելու միջոց.

«Բանակում կա, այսպես կոչված, «գաուբվախտի» ինստիտուտ: Առանց մեղքն ապացուցելու, առանց դատական համակարգի միջամտության զինվորին տանում են «գաուբվախտ», որտեղ նրան կարող են պահել մի որոշ ժամանակ, այնուհետև բաց թողնել: Դրա համար որևէ հրամանատար պատասխանատվության չի ենթարկվում: Հիմա Նիկոլ Փաշինյանին ինչ բերել են ՀՀ-ում ֆորմալ իշխանության, նա գործում է այդպես: Նա այդպես վարվեց և Ռոբերտ Քոչարյանի հետ ու մնաց անպատիժ: Եթե ինքն այդ գործողության համար պատժվեր, հետագայում Ավետիք Չալաբյանի և մյուսների նկատմամբ այդպիսի լկտիություն և սանձարձակություն իրեն թույլ չէր տա: 

Եթե հիշում եք, 2019 թվականի սկզբին բանտում լրագրող մահացավ, ում կալանավորել էին Փաշինյանի համար ոչ հարմար հրապարակումներ անելու համար: Լրագրողը հացադուլ էր հայտարարել և մահացավ՝ նույնիսկ մեղքը չապացուցված: Այսինքն՝ այն ինչ տեղի է ունենում ընդդիմադիրների հետ, բացահայտ այլանդակություն է, որը քաղաքականության և իրավական համակարգի հետ առհասարակ որևէ առնչություն չունի, և այս ամենը շարունակվելու է այնքան ժամանակ, քանի դեռ այս մարդը ՀՀ-ում ունի ազդեցություն, քանի դեռ նրա հրահանգները կատարում են իրավապահ համակարգի ներկայացուցիչները»:
