Օձուն գյուղի՝ 34-ամյա բնակչի սպանության գործից անջատված մասով նախաքննությունն ավարտվել է

ՀՀ քննչական կոմիտեի Լոռու մարզային քննչական վարչությունում ավարտվել է Օձուն գյուղի 34-ամյա բնակչի սպանության դեպքի առթիվ հարուցված քրեական գործից անջատված մասով  նախաքննությունը:

ՔԿ-ից հայտնում են, որ մինչդատական վարույթում իրականացված քննչական և դատավարական գործողությունների արդյունքում պարզվել են դեպքի հանգամանքները, շարժառիթը:

Քննությամբ մասնավորապես պարզվել է, որ Օձուն գյուղի 29-ամյա բնակչի և համագյուղացու միջև դեպքի օրը՝ 2021թ. փետրվարի 20-ին, անձնական հարցի կապակցությամբ ծագել էին տարաձայնություններ, ինչը որոշակի լարվածության պատճառ էր դարձել: Ստեղծված իրավիճակը հանգուցալուծելու և 29-ամյա երիտասարդից պարզաբանումներ ստանալու նպատակով նշված անձը դիմել էր մեկ այլ՝ գործով տուժող 34-ամյա համագյուղացուն, ով ժամը 19:30-ի սահմաններում, երիտասարդին պատժելու նպատակով, Օձուն գյուղի հրապարակում հանդիպել էր վերջինիս՝ պահանջելով  դուրս գալ ավտոմեքենայից:

Այս կապակցությամբ վիճաբանություն էր առաջացել, որի ընթացքում երիտասարդը, 34-ամյա համագյուղացուն ապօրինաբար կյանքից զրկելու՝ սպանելու դիտավորությամբ, իր մոտ գտնվող որսորդական հրացանով բազմակի կրակոցներ էր արձակել նրա կենսական կարևոր օրգանների՝ գլխի և որովայնի շրջաններին՝ պատճառելով կյանքի հետ անհամատեղելի մարմնական վնասվածքներ: 34-ամյա տղամարդը մահացել էր՝ հիվանդանոց տեղափոխվելու ճանապարհին:

Նախաքննության ընթացքում իրականացված օպերատիվ-հետախուզական և օպերատիվ-որոնողական միջոցառումների արդյունքում պարզվել էր 2021թ. մարտի 25-ից հետախուզման մեջ գտնվող  երիտասարդի գտնվելու վայրը: Վերջինս, նկատելով ժամանած ՀՀ ԱԱԾ և ոստիկանության աշխատակիցներին, փորձել էր փախուստի դիմել, որի ընթացքում  նետել էր իր մոտ առկա ռազմամթերքով լի պայուսակը. օրենքով սահմանված կարգով  իրականացված խուզարկությամբ նշված պայուսակի միջից հայտնաբերվել և վերցվել էին «Макаров» տեսակի ատրճանակ, 16 հատ 9մմ տրամաչափի փամփուշտներ, «Ф-1» տեսակի նռնակ, «Ф-1», «РГД -5» և «РГ-42» տեսակի նռնակների համար նախատեսված մարտական պայթուցիչ:

Ձեռք բերված բավարար ապացույցների համակցությամբ՝ 29-ամյա երիտասարդին մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 104-րդ հոդվածի 1-ին մասով և 235-րդ հոդվածի 1-ին մասով:

Նկատի ունենալով, որ կատարված նախաքննությամբ ձեռք բերված ապացույցները բավարար են՝ քրեական գործը մեղադրական եզրակացությամբ դատարան ուղարկելու համար՝ 29-ամյա երիտասարդի վերաբերյալ դրվագը քրեական գործից անջատվել է առանձին վարույթ և հայտարարվել նախաքննության ավարտի մասին։

Քրեական գործը՝ մեղադրական եզրակացությամբ, ուղարկվել է նախաքննության օրինականության նկատմամբ հսկողություն իրականացնող դատախազին՝ մեղադրական եզրակացությունը հաստատելու և դատարան ուղարկելու միջնորդությամբ:

Ապօրինի կերպով ձեռք բերված ռազմամթերքի մասով նախաքննությունը շարունակվում է:
