Պահանջում են կալանավորել կաթողիկոսի եղբորորդուն

Բարձրաստիճան պաշտոնատար անձի կողմից առանձնապես խոշոր չափերով կաշառք ստանալու դեպքի առթիվ ՀՀ ազգային անվտանգության ծառայությունում նախապատրաստված նյութերի հիման վրա հարուցված  և ՀՀ հակակոռուպցիոն կոմիտեում քննվող քրեական գործով կատարված նախաքննությամբ փաստական տվյալներ են ձեռք բերվել այն մասին, որ Կ. Ն.-ն, զբաղեցնելով Երևան քաղաքի Շենգավիթ վարչական շրջանի դատախազի տեղակալի պաշտոնը, Արմավիրի մարզի առաջին ատյանի ընդհանուր իրավասության դատարանի վարույթում քննվող քրեական գործով ամբաստանյալ Ն. Դ.-ի նկատմամբ մեղմ պատիժ նշանակելուն նպաստելու համար Գ. Գ.-ի և Ն. Ա.-ի օժանդակությամբ 2022 թվականի հունվարից մայիսն ընկած ժամանակահատվածում ամբաստանյալից անձամբ ստացել է առանձնապես խոշոր չափերի՝ 2.500.000 ՀՀ դրամ կաշառք:

Ըստ առաջադրված մեղադրանքի` Շենգավիթ վարչական շրջանի դատախազի տեղակալ Կ. Ն.-ն, Գ. Գ.-ի և Ն. Ա.-ի միջոցով նախապես ձեռք բերված պայմանավորվածության համաձայն, 2022 թվականի հունվարի 16-ին Արմավիրի մարզի Ոսկեհատ գյուղում հանդիպել է ամբաստանյալ Ն. Դ.-ի հետ և քննարկել վերջինիս վերաբերյալ քննվող քրեական գործի հանգամանքները: Հանդիպման ընթացքում Կ. Ն.-ն խոստացել է իր պաշտոնեական դիրքն օգտագործելով նպաստել դատարանի կողմից Ն. Դ.-ի նկատմամբ այնպիսի պատիժ նշանակելուն, որը հնարավորություն կտա վերջինիս համաներման մասին օրենքի հիման վրա ազատվել պատժից, ինչի համար ամբաստանյալից պահանջել է 2.500.000 ՀՀ դրամ կաշառք:

Արմավիրի մարզի առաջին ատյանի ընդհանուր իրավասության դատարանի 2022 թվականի մայիսի 17-ի դատավճռով Ն. Դ.-ն դատապարտվել է ազատազրկման 6 տարի ժամկետով, որպիսի պայմաններում հնարավորություն է ստացել համաներում հայտարարելու մասին 2018թ. նոյեմբերի 1-ին ընդունված օրենքի հիման վրա սահմանված կարգով ազատվել պատժից:

2022 թվականի մայիսի 19-ին Կ. Ն.-ն Գ. Գ.-ի տանը հանդիպել և Ն. Դ.-ից ստացել է պահանջված կաշառքի գումարից 2.000.000 ՀՀ դրամը, իսկ մնացած 460.000 ՀՀ դրամը Ն. Դ.-ն Ն. Ա.-ի օգնությամբ 2022 թվականի մայիսի 31-ին փոխանցել է Գ.Գ.-ի մտերիմ անձի բանկային հաշվեհամարին, ով նույն օրը գումարը կանխիկացրել և Գ. Գ.-ի միջոցով փոխանցել է պաշտոնատար անձին:

09.06.2022 թ.-ին ՀՀ հակակոռուպցիոն կոմիտեի քննիչի որոշմամբ Շենգավիթ վարչական շրջանի դատախազի տեղակալ Կ. Ն.-ն, վերջինիս կաշառք տված Ն. Դ.-ն և կաշառք ստանալուն օժանդակած  անձինք ձերբակալվել են:

Առանձնապես խոշոր չափերով կաշառք ստանալու համար 10.06.2022 թ.-ին Կ. Ն.-ին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 311-րդ հոդվածի 4-րդ մասի 2-րդ կետով: Առանձնապես խոշոր չափերով կաշառք տալու համար Ն. Դ.-ին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 312-րդ հոդվածի 3-րդ մասի 1-ին կետով, իսկ կաշառք ստանալուն օժանդակելու համար Ն. Ա.-ին և Գ. Գ.-ին մեղադրանք է առաջադրվել  ՀՀ քրեական օրենսգրքի 38-311-րդ հոդվածի 4-րդ մասի 2-րդ կետով:

ՀՀ հակակոռուպցիոն կոմիտեի քննիչի կողմից միջնորդություններ են ներկայացվել Երևան քաղաքի ընդհանուր իրավասության դատարան` վերը նշված բոլոր մեղադրյալների նկատմամբ կալանավորումը որպես խափանման միջոց ընտրելու համար:
