Ամբաստանյալը 3մլն դրամ գրավի դիմաց կալանքից ազատվել է և նորից հանցանք գործել․ գումարը պետականացվել է

Շարունակվել են արձանագրվել դեպքեր, երբ կալանքը որպես խափանման միջոց կիրառելու կամ կալանքի ժամկետը երկարացնելու վերաբերյալ քննչական մարմնի, դատախազության կողմից ներկայացվող հիմնավոր միջնորդությունները դատարանների կողմից մերժվելու արդյունքում մեղադրյալները կատարում են նոր հանցագործություններ: 

Մասնավորապես, ՀՀ պետական սահմանով առանձնապես խոշոր չափերով թմրամիջոցների մաքսանենգության, թմրամիջոցները իրացնելու նպատակով ապօրինի ձեռք բերելու, պահելու և փոխադրելու դեպքերի առթիվ ՀՀ ԱԱԾ քննչական դեպարտամենտում հարուցված քրեական գործով Ռ. Օ.-ին մեղադրանք է առաջադրվել 38-266-րդ հոդվածի 3-րդ մասի 2-րդ կետով:

2018 թ. նոյեմբերի 20-ին որոշում է կայացվել քրեական գործից մաս անջատելու մասին և ըստ մեղադրանքի` երեք անձի, այդ թվում նաև Ռ. Օ.-ի, մեղադրական եզրակացությամբ գործն ուղարկվել է դատարան ըստ էության քննելու համար:

Լոռու մարզի ընդհանուր իրավասության դատարանը 2020 թ. մայիսի 27-ին բավարարել է ամբաստանյալ Ռ. Օ.-ի պաշտպանի միջնորդությունը, ամբաստանյալի  նկատմամբ ընտրված խափանման միջոց կալանավորումը փոփոխել և նրա նկատմամբ որպես խափանման միջոց է ընտրել 3.000.000 ՀՀ դրամ գումար գրավը:

Քրեական գործի դատաքննության ընթացքում պարզվել է, որ խափանման միջոցի փոփոխությունից հետո վերջինս կատարել է ՀՀ քր. օրենսգրքի 235-րդ հոդվածի 1-ին մասով նախատեսված նոր հանցանք, որի համար Սյունիքի մարզի առաջին ատյանի ընդհանուր իրավասության դատարանի 2022թ. մարտի 15-ի դատավճռով մեղավոր է ճանաչվել, դատապարտվել ազատազրկման: ՀՀ քրեական օրենսգրքի 70-րդ հոդվածի կիրառմամբ պատիժը պայմանականորեն չի կիրառվել և սահմանվել է փորձաշրջան՝ 1 տարի ժամկետով:  Նշված դատավճիռը չի բողոքարկվել և մտել է օրինական ուժի մեջ:

Նկատի ունենալով, որ ամբաստանյալ Ռ. Օ.-ն դատարանի կողմից իր նկատմամբ որպես խափանման միջոց ընտրված կալանավորումը փոփոխվելուց և 3.000.000 ՀՀ դրամ գրավ կիրառվելուց հետո կատարել է նոր հանցանք, մեղադրող դատախազի կողմից միջնորդություն է ներկայացվել Լոռու մարզի առաջին ատյանի ընդհանուր իրավասության դատարան՝ նրա նկատմամբ որպես խափանման միջոց ընտրված 3.000.000 ՀՀ դրամ գրավը պետականացնելու, խափանման միջոցը փոփոխելու և կալանավորումը որպես խափանման միջոց ընտրելու մասին:

Դատարանը 2022 թ. մայիսի 12-ին մեղադրող դատախազի միջնորդությունը բավարարել է մասնակի՝ ամբաստանյալի նկատմամբ որպես խափանման միջոց ընտրված 3.000.000 ՀՀ դրամ գումարը պետականացվել է և նրա նկատմամբ որպես խափանման միջոց է ընտրվել չհեռանալու մասին ստորագրությունը:
