Զորամաս ապօրինի մուտք գործելու, հրամանատարի տեղակալի նկատմամբ բռնություն գործադրելու, դեպքի առթիվ հարուցվել է քրգործ

ՀՀ քննչական կոմիտեի զինվորական քննչական գլխավոր վարչության չորրորդ կայազորային քննչական բաժնում քննություն է տարվում՝ N զորամաս ապօրինի մուտք գործելու, հրամանատարի տեղակալի նկատմամբ առերևույթ բռնություն գործադրելու, ծանր վիրավորանք հասցնելու  դեպքի բոլոր հանգամանքները պարզելու ուղղությամբ:

Նախնական տվյալներով, 2022թ. մայիսի 17-ին՝ ժամը 14:05-ի սահմաններում, մի խումբ անձինք, սահմանված կարգի խախտմամբ, մուտք են գործել ՀՀ ՊՆ N զորամասի տարածք, որի ընթացքում չենթարկվելով զորամասի տարածքը լքելու՝ զորամասի հրամանատարի սպառազինության գծով տեղակալ, գնդապետի օրինական պահանջին, ծառայողական պարտականությունները կատարելու կապակցությամբ, հայհոյել են, քաշքշել և բռնություն գործադրել նրա նկատմամբ՝ պլաստմասե շշով հարվածելով դեմքին:

Դեպքի առթիվ հարուցվել է քրեական գործ՝ զորամաս կամ հատուկ պահպանվող զինվորական այլ տարածք ապօրինի մուտք գործելու, ծանր վիրավորանք հասցնելու և իշխանության ներկայացուցչի նկատմամբ բռնություն գործադրելու հատկանիշներով: Որոշում է կայացվել քրեական գործի նախաքննությունը հանձնարարել քննչական խմբին:

Նախաքննության ընթացքում իրականացված անհետաձգելի միջոցառումների արդյունքում պարզվել են իշխանության ներկայացուցչի նկատմամբ առերևույթ բռնություն գործադրած և ծանր վիրավորանք հասցրած անձանցից երեքի ինքնությունը, ովքեր Գարիկ և Արթուր Գալեյան եղբայրներն են, ինչպես նաև՝ քաղաքացի Ազգուշ Մարտիրոսյանը:

Նրանցից մեկը՝ Գարիկ Գալեյանը, ձերբակալվել է և ձեռք բերված բավարար ախացույցների համակցությամբ նրան մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 327.6-րդ հոդվածի 3-րդ մասի 1-ին կետով, 137.1-րդ հոդվածի 1-ին մասով և 316-րդ հոդվածի 1-ին մասով:

Վարույթն իրականացնող մարմինը Արթուր Գալեյանին ձերբակալելու որոշում է կայացրել, որը կատարման նպատակով ուղարկել է հետաքննության մարմնին: Ձեռնարկվում են անհրաժեշտ միջոցառումներ՝ նրան հայտնաբերելու և նախաքննական մարմնին ներկայացնելու ուղղությամբ:

Նախաքննությունը շարունակվում է:

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ,քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
