Դատախազը պահանջում է մեղավոր ճանաչել Շշի Մելոյի սպանության փորձի գործով ամբաստանյալներին.արդարացման դատական ակտի դեմ բողոք է ներկայացվել

Դատախազությունը պահանջում է բեկանել ԱԺ նախկին պատգամավոր Մելիք Մանուկյանի՝ «Շշի Մելոյի» սպանության փորձի գործով արդարացման դատավճիռը և մեղավոր ճանաչել ամբաստանյալներին՝ դատապարտելով ազատազրկման 17, 19 և 20 տարի ժամկետով։ 

Հիշեցնենք, որ «Շշի Մելոյի» սպանության ենթադրյալ փորձը տեղի է ունեցել 2019թ օգոստոսի 2-ին՝ Երեւան-Սեւան ավտոճանապարհին, Մելիք Մանուկյանին պատկանող ապակե տարաների գործարանի մոտ։

Դեպքի առթիվ հարուցվել է քրեական գործ ՀՀ ՔՕ-ի 34-104 -րդ հոդվածի 2-րդ մասի 6-րդ կետի՝ շատերի կյանքի համար վտանգավոր եղանակով սպանության փորձը եւ ՔՕ 235 -րդ հոդվածի 1-ին կետի՝ ապօրինի կերպով զենք–զինամթերք ձեռք բերելը, պահելը հոդվածների հատկանիշներով: Գործի շրջանակներում կալանավորվել են Շիրակի մարզի բնակիչներ 56-ամյա Արթուր Մխիթարյանը, 53-ամյա Պետրոս Էլբակյանը եւ 45-ամյա Ջեմսիկ Մարտիրոսյանը, որոնք չեն ընդունում առաջադրված մեղադրանքը և հերքում են իրենց առնչությունը կատարված դեպքի հետ։ Մելիք Մանուկյանն այս գործով ունի տուժողի կարգավիճակ։
Կոտայքի մարզի ընդհանուր իրավասության դատարանը՝ դատավոր Գոռ Շահբազյանի նախագահությամբ, 2022թ հունվարին արդարացրել է ամբաստանյալներ Արթուր Մխիթարյանին, Ջեմսիկ Մարտիրոսյանին և Պետրոս Էլբակյանին՝ սպանության փորձի, ապօրինի զենք-զինամթերքի և գույքի դիտավորության ոչնչացման դրվագներով։ Ամբաստանյալներից մեկը՝ Ջեմսիկ Մարտիրոսյանը, մեղավոր է ճանաչվել ՀՀ քրեական օրենսգրքի 112-րդ հոդվածի հատկանիշներով (դիտավորությամբ առողջությանը ծանր վնասվածք պատճառելը) առաջադրված մեղադրանքում՝ դատապարտվելով ազատազրկման՝ 4 տարի 6 ամիս ժամկետով։

Դատախազությունը վերաքննիչ բողոք է ներկայացրել՝ պահանջելով բեկանել արդարացման դատական ակտը և մեղավոր ճանաչել ամբաստանյալներին առաջադրված մեղադրանքում։ Դատախազությունը պահանջում է Ջեմսիկ Մարտիրոսյանին մեղավոր ճանաչել իրեն վերագրվող մյուս՝ դիտավորությամբ առողջությանը ծանր վնաս պատճառելու հոդվածով: Դատական ակտի դեմ վերաքննիչ բողոք է ներկայացրել նաև պաշտպանության կողմը։ Մասնավորապես, Ջեմսիկ Մարտիրոսյանի պաշտպանները պահանջում են արդարացնել Մարտիրոսյանին՝ ՀՀ ՔՕ 112-րդ հոդվածի 1-ին մասով ևս։ Պետրոս Էլբակյանի պաշտպանն էլ վերաքննիչ բողոքով վիճարկում է դեպքի վայրի քննության արձանագրության, ինչպես նաև իրեղեն ապացույցների՝ թույլատրելի ապացույց լինելու հանգամանքը:

Գործը կքննվի Վերաքննիչ քրեական դատարանի դատավոր Վազգեն Ռշտունու նախագահությամբ, կազմով դատավորներ՝ Արշակ Վարդանյանի, Արսեն Նիկողոսյանի։
