Վարչապետի աշխատակազմը հայտարարություն տարածեց

Վարչապետի աշխատակազմի պարզաբանումը ՀՀ վարչական դատարանի թիվ ՎԴ/2014/05/21 վարչական գործով ընդունված հայցի ապահովման որոշման կապակցությամբ

ՀՀ ԶՈՒ գլխավոր շտաբի պետ Օնիկ Գասպարյանը սահմանադրական նորմի հիմքով` իրավունքի ուժով ուժի մեջ մտած Հանրապետության նախագահի հրամանագրի հիման վրա, 10.03.2021 թ․-ին, ազատվել է զբաղեցրած պաշտոնից, ինչն արձանագրել է ՀՀ վարչապետը նույն օրը տարածված հայտարարությամբ։

Օնիկ Գասպարյանի կողմից ՀՀ վարչական դատարան է ներկայացվել նախ վիճարկման հայց՝ խնդրելով անվավեր ճանաչել նախագահի հրամանագիրը, որը հաստատվել է 2021 թ․-ի մարտի 10-ի՝ վարչապետի՝ Օնիկ Գասպարյանին ՀՀ ԶՈՒ գլխավոր շտաբի պետի պաշտոնից իրավունքի ուժով ազատված համարելու մասին հայտարարությամբ և ճանաչման հայց՝ առ ոչինչ ճանաչել նույն հրամանագիրն առ ոչինչ ճանաչելու պահանջովը։

ՀՀ վարչական դատարանի կողմից, 15.03.2021 թ.-ին, վերադարձվել է հայցը և առաջարկվել ոչ ճիշտ հայցատեսակը պատշաճ հայցատեսակով փոխարինել (վերադարձնելու որոշումը հավանաբար հայցվորին տրվել է առձեռն՝ նախապես տեղեկացնելով, քանի որ նույն օրը հայցվորը ներկայացրել է փոփոխված հայցը, նույն որոշումը առձեռն չի տրամադրվել պատասխանողին):

Նույն օրը, ներկայացվել է փոխարինված հայցը` Օնիկ Գասպարյանի հայցադիմումն ընդդեմ Հայաստանի Հանրապետության նախագահ Արմեն Սարգսյանի, Հայաստանի Հանրապետության վարչապետ Նիկոլ Փաշինյանի՝ ԶՈՒ գլխավոր շտաբի պետ Օնիկ Գասպարյանին պաշտոնից ազատելու վերաբերյալ վարչապետի՝ Հանրապետության նախագահին արված առաջարկության հիման վրա Հանրապետության նախագահի կողմից վարչական ակտ ընդունված չլինելու պայմաններում իրավունքի ուժով ԶՈՒ գլխավոր շտաբի պետին պաշտոնից ազատելու իրավահարաբերության բացակայությունը ճանաչելու պահանջի մասին, որն ընդունել է վարույթ: Ներկայացվել է նաև հայցի ապահովման միջնորդություն:

Դատարանի կողմից, 17.03.2021 թ.-ին բավարարվել է հայցի ապահովման միջնորդությունը, որոշվել է` ձեռնարկել հայցի ապահովման միջոց՝ հայցվորի պահանջի ժամանակավոր բավարարման տեսքով, այն է՝ մինչև սույն գործով գործն ըստ էության լուծող վերջնական դատական ակտի օրինական ուժի մեջ մտնելը ճանաչել ԶՈՒ գլխավոր շտաբի պետ Օնիկ Գասպարյանին պաշտոնից ազատելու վերաբերյալ վարչապետի՝ Հանրապետության նախագահին արված առաջարկության հիման վրա Հանրապետության նախագահի կողմից վարչական ակտ ընդունված չլինելու պայմաններում իրավունքի ուժով ԶՈՒ գլխավոր շտաբի պետին պաշտոնից ազատելու իրավահարաբերության բացակայությունը:

Հարկ է նշել, որ ՀՀ Սահմանադրության 139-րդ հոդվածի 2-րդ մասի համաձայն համապատասխան ակտը, տվյալ դեպքում՝ ՀՀ նախագահի հրամանագիրն ուժի մեջ է իրավունքի ուժով:

Սահմանադիրը նշված սահմանադրական նորմի ուժով ուժի մեջ մտած ակտի շրջադարձի հնարավորություն չի նախատեսել։

Հետևաբար, Օնիկ Գասպարյանը ազատված է ՀՀ ԶՈՒ ԳՇ պետի պաշտոնից, իսկ ՀՀ Սահմանադրության 139-րդ հոդվածի 2-րդ մասով սահմանված ընթացակարգով ՀՀ ԶՈՒ գլխավոր շտաբի նոր պետի նշանակման գործընթացը շարունակվում է։
