Գյումրու համալսարանի ՀՀԿ–ական տնօրենը դատարան դիմելուց հետո ստիպված է եղել մաքրել անցյալի սխալները. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Պարզվում է երեք տարուց ավելի «Գյումրու մշակույթի վարժարան» պետական ոչ առևտրային կազմակերպության երեք տասնյակ ուսուցիչներ պայքարում էին իրենց 2014 թվականի դեկտեմբեր ամսվա աշխատավարձը ստանալու համար: Ու թեև դպրոցի տնօրինությունը խոստացել էր վճարել ուսուցիչների չվճարված աշխատավարձերը, բայց այդպես էլ իր խոստումը չէր իրականացրել:
Դրանից բացի, կառավարության որոշմամբ 2015 թվականի դեկտեմբերին «Գյումրու մշակույթի վարժարան»–ը միացվել էր «Շիրակի Մ. Նալբանդյանի անվան պետական համալսարան» հիմնադրամին: Միավորումից հետո ուսուցչները դիմել էին վերակազմավորված կրթօջախի տնօրեն, Շիրակի մարզի ՀՀԿ կառույցի ղեկավար Սահակ Մինասյանին, չվճարված աշխատավարձերը փոխհատուցելու պահանջով:
Տնօրենը, սակայն ուսուցիչների հարցմանն ի պատասխան ասել է, որ նրանց աշխատավարձը ժամանակին փոխանցվել է վարժարանին և համալսարանը այդ մասով որևէ պարտավորություն չունի:
2016թ. նոյեմբերին ուսուցիչները դիմել էին «АМ» իրավաբանական ընկերությանը, որն էլ ստանձնելով ուսուցիչների շահերի պաշտպանությունը դիմել էր Շիրակի մարզի ընդհանուր իրավասության դատարան, չվճարված աշխատավարձի ու աշխատավարձի վճարման կետանցված տոկոսների բռնագանձման պահանջով:
Պահանջն ուսումնասիրելու արդյունքում հիմնավորվել է, որ «Գյումրու մշակույթի վարժարան» պետական ոչ առևտրային կազմակերպության իրավահաջորդը «Շիրակի պետական համալսարանն» է, որն էլ պարտավոր է վճարել ուսուցիչների աշխատավարձը:
Հիմնավոր ապացույցների ճնշման տակ արդեն դատական առաջին նիստից անմիջապես հետո պատասխանող կողմը՝ «Շիրակի պետական համալսարան» ՊՈԱԿ–ը ինքնակամ ցանկություն է հայտնել բանակցել և հաշտության համաձայնություն կնքել ուսուցիչների հետ:
2017 թ.–ի հունվարի 25–ին կայացած առաջին իսկ դատական նիստից անմիջապես հետո, պատասխանող կողմը ցանկություն է հայտնեց բանակցել և հաշտության համաձայնություն կնքել ուսուցիչների հետ: Իսկ մինչև երկրորդ դատական նիստը՝ մարտի 2–ը «Շիրակի պետական համալսարան» ՊՈԱԿ–ը կատարել է իր պարտավորությունները: Բոլոր ուսուցիչներին վճարել է երեք տարի առաջվանից մինչ օրս չվճարված աշխատավարձն ու աշխատավարձի վճարման կետանցված օրվա համար սահմանված տույժի գումարները:
Դժվար է ասել, որ եթե տարին նախընտրական չլիներ, ապա ՀՀԿ–ական ռեկտորն այդքան հեշտ կհամաձայնե՞ր հաշտության գալ ուսուցիչների հետ, թե նրանց աշխատավարձերը չվճարելու համար կհասներ մինչև ՄԻԵԴ: Բայց քանի որ այս անգամ ՀՀԿ–ն որոշել է իր շուրջ ավելորդ աղմուկ–աղաղակ չբարձրացնել ու նաև «պահպանել» օրենքի տառը, գուցե և այդ է պատճառը, որ Սահակ Մինասյանն էլ իր հերթին է որոշել գնալ նման «փոխզիջման»: Հակառակ դեպքում ոչ ուսուցիչները տարիներով առանց աշխատավարձի կմնային, ոչ էլ աշխատավարձի գործը կհասներ դիվանբաշուն:
