Անչափահասը սեքսուալ բնույթի բռնի գործողություններ է կատարել մեկ այլ անչափահասի նկատմամբ

ՀՀ քննչական կոմիտեի հատկապես կարևոր գործերի քննության գլխավոր վարչության մարդու դեմ ուղղված հանցագործությունների քննության վարչությունում իրականացված բազմակողմանի քննությամբ պարզվել և հիմնավորվել է, որ 2022 թվականի նոյեմբերին ՀՀ մարզերից մեկի անչափահաս բնակիչը կարևոր տվյալ հայտնելու պատրվակով հանդիպել է մեկ այլ անչափահաս բնակչուհու հետ, որի  ժամանակ բռնություն գործադրելով վերջինիս նկատմամբ՝ կատարել է սեքսուալ բնույթի բռնի գործողություններ:

Բացի այդ, նշված անչափահասը, մեկ այլ քրեական վարույթի շրջանակում  հանդիսանալով որպես վկա, 2024 թվականի նոյեմբերի 14-ին լրացուցիչ հարցաքննության ժամանակ, նախազգուշացված լինելով ՀՀ քրեական դատավարության օրենսգրքի 58-րդ հոդվածի 2-րդ մասի 2-րդ կետով սահմանված՝ ցուցմունք տալու, ինչպես նաև հարցերին ճշմարտացի պատասխանելու պարտականություններ ունենալու, ապա այդ պարտականություններից հրաժարվելու դեպքում՝ ՀՀ քրեական օրենսգրքի 503-րդ հոդվածով սահմանված քրեական պատասխանատվության մասին, ապօրինի հրաժարվել է ծանր հանցագործությունների, մասնավորապես՝ մի շարք անչափահասների կողմից մեկ այլ անչափահասի նկատմամբ սեքսուալ բնույթի գործողություններ կատարելու և վերջինիս առևանգելու առնչությամբ իրեն հնարավոր հայտնի հանգամանքների մասին ցուցմունք տալուց:

Անչափահասի նկատմամբ հարուցվել է հանրային քրեական հետապնդում՝ Քրեական օրենսգրքի 198-րդ հոդվածի 3-րդ մասի 2-րդ կետով (սեքսուալ բնույթի բռնի գործողությունները, որը կատարվել է 12-ից 14 տարին չլրացած անձի նկատմամբ) և 503-րդ հոդվածի 2-րդ մասի 2-րդ կետով (ցուցմունք, եզրակացություն կամ կարծիք տալուց կամ թարգմանություն կատարելուց հրաժարվելը՝ ծանր կամ առանձնապես ծանր հանցագործության առնչությամբ)։

Քրեական վարույթը մեղադրական եզրակացությամբ ուղարկվել է հսկող դատախազին՝ այն հաստատելու և ըստ էության քննության առնելու համար դատարան ուղարկելու միջնորդությամբ:

Ծանուցում. հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ Քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով։
