Ֆիզիկական անձանց եկամուտների հայտարարագրման գործընթացը կդառնա առավել պարզ և ավտոմատացված

 

Ազգային ժողովն ընդունել է «Հայաստանի Հանրապետության հարկային օրենսգրքում լրացումներ և փոփոխություններ կատարելու մասին» օրենքի նախագիծը և հարակից նախագծերի փաթեթը, որոնք միտված են ֆիզիկական անձանց եկամուտների հայտարարագրման համակարգի պարզեցմանն ու կատարելագործմանը։

Օրենքով  ներդրվելու է ֆիզիկական անձանց եկամտային հարկի տարեկան հաշվարկի (հայտարարագրի) նախալրացման և ավտոմատ ներկայացման նոր մեխանիզմ։ Փոփոխությունների համաձայն՝ հարկային մարմինը, իր տեղեկատվական բազայում առկա տվյալների հիման վրա, նախալրացնելու է ֆիզիկական անձանց եկամտային հարկի տարեկան հայտարարագրերը.

✅Նոյեմբերի 1-ից, ինքնաշխատ լրացվելու են հարկային գործակալից ստացվող աշխատավարձը և դրան հավասարեցված այլ վճարումները, քաղաքացիաիրավական պայմանագրով աշխատանքի (ծառայության) դիմաց վարձատրությունը, ժամանակավոր անաշխատունակության, մայրության նպաստները, ինչպես նաև աշխատողի այլ եկամուտները (ռոյալթին, վարձավճարը, շահաբաժինը, նվիրատվությունը, գույքի (բացառությամբ սույն գլխի 7-րդ կետում նշված) օտարումից եկամուտը, կառուցապատողի կողմից շենքի, դրա բնակարանների կամ այլ տարածքների օտարումից եկամուտը, շահումը, մրցանակը, ապահովագրավճարը, կամավոր կենսաթոշակը, այլ եկամուտները)։

✅Ինքնաշխատ լրացվելու են նաև պետական բյուջեից ստացվող կուտակային հատկացումների լրացուցիչ միջոցները, մեկ մարդատար տաքսի ավտոմոբիլով փոխադրումներ իրականացնելու գործունեությունից ստացվող եկամուտները, հիփոթեքային վարկի սպասարկման համար վճարված տոկոսների գումարների գծով փոխհատուցված գումարը, ուսման վարձի գծով փոխհատուցված գումարը և կանոնադրական կամ բաժնեհավաք կապիտալում ներդրված շահաբաժնի գծով փոխհատուցված գումարը:

✅Եթե ֆիզիկական անձը սահմանված ժամկետում փոփոխություններ չկատարի, հայտարարագիրը կհամարվի ներկայացված՝ առանց լրացուցիչ գործողությունների։ Միաժամանակ, ֆիզիկական անձը կարող է փոփոխել նախալրացված հայտարարագիրը և այն էլեկտրոնային ստորագրությամբ ներկայացնել հարկային մարմին։

Սոցիալական ծախսը ենթակա կլինի փոխհատուցման միայն այն դեպքում, եթե ֆիզիկական անձը հարկային մարմին ներկայացնի էլեկտրոնային ստորագրությամբ վավերացված եկամտային հարկի տարեկան հայտարարագիրը։

Սահմանվել է, որ հայտարարագրման ենթակա չեն լինելու ընտանիքի անդամներից ստացվող՝ նվազեցվող (չհարկվող) եկամուտները։ Ընդ որում, տվյալ դրույթի մասով ֆիզիկական անձի ընտանիքի անդամներ են համարվում նրա ամուսինը, ծնողները, քույրերը, եղբայրները, զավակները (որդեգրողներն ու որդեգրվածները), պապերը, տատերը և թոռները:

Սահմանվել է նաև, որ ֆիզիկական անձի համաձայնության դեպքում հարկային մարմինը տվյալներ է ստանալու նաև ֆինանսական կազմակերպություններից։

Օրենքով եկամտային հարկի տարեկան հաշվարկ (հայտարարագիր)  չներկայացնելու համար սահմանված վարչական պատասխանատվությունը հանվում  է։
