Ազատի զորամասի հրդեհի գործով առաջին դատավճիռը. 3 տարի ազատազրկում՝ կրտսեր սերժանտի նկատմամբ

Գեղարքունիքի մարզի առաջին ատյանի ընդհանուր իրավասության դատարանը 2025 թվականի օգոստոսի 21-ին կայացրել է մեղադրական դատավճիռ. մեղադրյալ կրտսեր սերժանտ Ռ.Մ.-ն դատապարտվել է 3 տարի ժամկետով ազատազրկման:

Այս մասին հայտնում են Գլխավոր դատախազությունից։

Ժամկետային զինծառայող, կրտսեր սերժանտ Ռ․Մ․-ն, ով 2023 թվականի հունվարի 18-ից 19-ն ընկած ժամանակահատվածում ընդգրկված է եղել  վաշտի վերակարգում և որպես վաշտի հերթապահ ծառայություն է իրականացրել Գեղարքունիքի մարզի Ազատ գյուղում գտնվող ՀՀ ՊՆ N զորամասի ինժեներասակրավորային վաշտի անձնակազմի տեղակայման վայրում, մեղավոր է ճանաչվել Քրեական օրենսգրքի 543-րդ հոդվածի 3-րդ կետով (ներքին ծառայության կանոնագրքային կանոնները խախտելը, որն անզգուշությամբ առաջացրել է մարդու (մարդկանց) մահ) նախատեսված հանցագործության կատարման մեջ:

Հիշեցնենք, որ վաշտի հերթապահ Ռ․Մ․-ն 2023 թվականի հունվարի 19-ին՝ ժամը 00:30-ից 01:00-ն ընկած ժամանակահատվածում, պատասխանատու լինելով ներքին կարգուկանոնի, անձնակազմի, սպառազինության, ռազմական տեխնիկայի և զինամթերքի, շինությունների և ունեցվածքի անվտանգության և պահպանման համար, ինչպես նաև ներքին ծառայության կանոնագրքի պահանջների համաձայն՝ կրելով վառարանը վառելուն հետևելու պարտականություն, անհարկի բացակայել էր կացարանից`  բջջային հեռախոսով խոսելու նպատակով: Բացակայելու պատճառով Ռ․Մ․-ն չի նկատել ու չի փորձել կանխել ինժեներական ծառայության սպա, կապիտան Ե.Հ.-ի առերևույթ վտանգավոր գործողությունները, իսկ դրանից հետո ժամանակին չի ձեռնարկել միջոցներ հրդեհի բռնկման սկզբնական փուլում վտանգի ենթակա անձնակազմը, սպառազինությունը և նյութական այլ միջոցները փրկելու համար, ինչն անզգուշությամբ առաջացրել է մարդու (մարդկանց) մահ: Կացարանում գտնվող նույն վաշտի պարտադիր ժամկետային 15 զինծառայողները ժամանակին չեն տարհանվել, հակահրդեհային պաշտպանության համապատասխան միջոցների բացակայության պատճառով չեն կարողացել մարել հրդեհը և կացարանից դուրս գալ չկարողանալով՝ մահացել են, իսկ երեքը՝ ստացել տարբեր աստիճանի այրվածքներ:

Նշենք, որ Ե.Հ.-ի նկատմամբ հարուցված է հանրային քրեական հետապնդում՝ Քրեական օրենսգրքի 532-րդ հոդվածի 4-րդ մասով (զենքի, ռազմամթերքի, ռազմական տեխնիկայի կամ ռազմական այլ գույքի, շրջապատի համար առավել վտանգ ներկայացնող նյութերի, սարքերի կամ առարկաների հետ վարվելու կանոնները խախտելը, որն անզգուշությամբ առաջացրել է երկու կամ ավելի անձանց մահ). վարույթը դատաքննության փուլում է:

Ծանուցում. հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ Քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
