Որևէ կառույց իրավասություն չունի՞. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Օրերս մենք տեղեկացրել էինք, որ հայաստանյան քաղաքական ուժերից մեկը հարցումներ է ուղարկել պետական գերատեսչությունների՝ կապված ՀՀ վարչապետի պաշտոնը զբաղեցնող Նիկոլ Փաշինյանի գործողությունների իրավաչափության հետ: ՀԻշեցնենք, որ հարցը ձևակերպված է եղել այսպես. «Հայաստանի Հանրապետության վարչապետը իրավունք ունի՞ Հայաստանի Հանրապետության անունից ստորագրել խաղաղության պայմանագիր, հրաման տալ մարտական հենակետերից զորքերի հետ քաշման վերաբերյալ, տալ հանձնարարական՝ անձին կալանավորելու վերաբերյալ, վիրավորել Հայաստանի հանրապետության քաղաքացուն։ Եթե այո, ապա խնդրում եմ նշել իրավական այն ակտը (օրենքներ, ենթաօրենսդրական կարգավորումներ), որով սահմանվում են տվյալ գործառույթների իրականացումը»:

Արձանագրելով, որ ՄԻՊ գրասենյակից, արդարադատության նախարարությունից, ԱԱԾ-ից «ցրողական» պատասխաններ են ստացվել՝ մոտավորապես այն բովանդակությամբ, թե դա իրենց իրավասությունից դուրս է, նաև տեղեկացրել էինք, որ ավելի քան երկու ամիս որևէ պատասխան չի ստացվել Սահմանադրական դատարանից: Եվ ահա, մեր հրապարակումից հետո ստացվել է նաև ՍԴ պատասխանը, որտեղ մասնավորաբար նշված է. «Սահմանադրության 167րդ հոդվածի համաձայն, Սահմանադրական դատարանի լիազորությունները սահմանվում են Սահմանադրությամբ, իսկ կազմավորման և գործունեության կարգը` Սահմանադրությամբ և «Սահմանադրական դատարանի մասին» սահմանադրական օրենքով: Նշված նորմատիվ իրավական ակտերում ամրագրված լիազորությունների ուսումնասիրությունը ցույց է տալիս, որ Սահմանադրական դատարանը որևէ պետական մարմնի կամ պաշտոնատար անձի լիազորությունների վերաբերյալ պարզաբանում տալու լիազորություն չունի»:

Այսինքն, փաստացի նույն պատասխանը, ինչ մյուս մարմինները: Ստացվում է՝ ոչ մեկն իրավասություն չունի պատասխանել արտաքուստ տարրական թվացող հարցերին, որևէ մեկն իրավասություն չունի պարզաբանել Հայաստանի Սահմանադրությունն ու օրենքները: Հետաքրքիր է՝ Հայաստանում կա՞ այնպիսի մարմին, որը նման լիազորություն կամ իրավասություն ունի: Թե բոլորի լիազորություններն ու իրավասություններն ավարտվում են այնտեղ, որտեղ առկա է Նիկոլ Փաշինյանի գործոնը...

Ի դեպ, հավելենք, որ, նախորդ հրապարակումից հետո մեզ հայտնի դարձավ, որ օրենքով սահմանված կարգով հարցմանը չեն պատասխանել նաև գլխավոր դատախազությունից:
