Իշխանությունները հակված չեն կատարել արբիտրաժային դատարանի որոշումը

Հայաստանի գործող իշխանությունները հակված չեն կատարել արբիտրաժային դատարանի որոշումը, թեև այն պարտադիր կատարման ենթակա է։ Կալանավորված գործարար Սամվել Կարապետյանի փաստաբանական թիմը երեկ հայտարարեց, որ ՀԷՑ-ն ազգայնացնելու կառավարության քայլերի դեմ միջազգային արբիտրաժային հրատապ գործ են հաղթել։ Ըստ Կարապետյանի պաշտպանների՝ Ստոկհոլմի առևտրային պալատի արբիտրաժային ինստիտուտը Հայաստանի Հանրապետությանը պարտավորեցրել է ձեռնպահ մնալ շաբաթներ առաջ փոխված օրենքներով սահմանված դրույթների կիրառումից և ընկերության բռնագրավման հետագա քայլերից։ Հայցի հիմքում Կարապետյանները ներդրումային պաշտպանության մասին Հայաստանի ու Կիպրոսի միջև 30 տարի առաջ կնքված համաձայնագիրն են դրել։ Կարապետյանը «Հայաստանի էլեկտրական ցանցերը» տնօրինում է Կիպրոսում գրանցված մի ընկերության անունով։

Փաշինյանական իշխանությունը իր գրանցած պարտությունը չի ընդունում, չի էլ հերքում։

Փոխարենը փորձում է տարբեր ձևակերպումներով ձեռնպահ մնալ դրանց կատարումից, ներկայացնում, թե դա ընդամենը միջանկյալ որոշում է և որևէ կերպ չի ազդում իրենց տրամադրության և ցանկությունների վրա։ Ավելին, հայտարարել են, թե շարժվելու են հայաստանյան օրենսդրությամբ, մինչդեռ միջազգային պայմանագրերը ևս ներպետական օրենսդրության մաս են և Սահմանադրությամբ ավելի բարձր են ճանաչում, քան Հայաստանում ընդունված օրենքները։

Ուստի և, գործող իշխանությունների ապօրինությունները նոր դրսևորումներ են ստանալու, փաստացի այս կերպ հարվածելով Հայաստանի ընդհանուր ներդրումային վիճակին։ Իշխանությունները զերծ չեն մնում ապօրինություններ կատարելուց։ Դա, իհարկե, լրջագույն հետևանքներ է ունենալու հետագայում և ընդհանրապես Հայաստանի Հանրապետության համար։ Բայց կարծես, փաշինյանական իշխանությանը նման մանր-մունր հարցերը չեն հետաքրքրում։ Նրանց համար ավելի կարևոր է, նույնիսկ երկրի հեղինակությանը հարվածելու գնով, պատժել կալանավորված գործարարին, բռնագրավել նրա գույքը։ Առաջիկայում ավելի լուրջ լսումներ են սպասվում ոչ միայն այս, այլ նաև այլ գործերով և դրանք հերթական հարված են լինելու Հայաստանի Հանրապետության հեղինակության։
