ԱԱԾ-ն բացահայտել է անօրինական միգրացիայի կազմակերպմամբ զբաղվող հանցավոր խումբ

ՀՀ Ազգային անվտանգության ծառայության քննչական վարչությունում քննվող մի շարք քրեական գործերով իրականացված մեծածավալ օպերատիվ միջոցառումների և քննչական գործողությունների արդյունքում բացահայտվել է անօրինական միգրացիայի կազմակերպմամբ զբաղվող հանցավոր խումբ:
Ինչպես տեղեկացրին ԱԱԾ լրատվական ծառայությունից, ձեռք բերված նախնական տվյալների համաձայն՝ Հայաստանում և արտերկրում կայուն ու համակարգված կապեր ունեցող մի խումբ անձինք 2016 թվականի ընթացքում տուրիստական գործունեության քողի ներքո, շուրջ երկու հարյուր ՀՀ քաղաքացիների համար կեղծ փաստաթղթեր ու տեղեկություններ ներկայացնելով, հետխորհրդային երկրներում տեղակայված Շենգենյան համաձայնության երկրների դեսպանություններից ձեռք են բերել մուտքի արտոնագրեր՝դրա դիմաց կատարված կեղծիքներից անտեղյակ քաղաքացիներից վերցնելով 2.0 00-3.500 եվրո գումար։

Նախաքննության ընթացքում պարզվել է նաև, որ ձևավորված հանցավոր մեխանիզմում ներգրավված են եղել պետական հատուկ ծառայություն իրականացնող պաշտոնատար անձինք, ովքեր տարբեր չափի կաշառքներով ապահովել են ապօրինի հիմքերով ստացված արտոնագրերով քաղաքացիների անարգել ելքը Հայաստանի Հանրապետությունից:

Առերևույթ հանցագործություններ կատարելու համար հինգ անձի մեղադրանքներ են առաջադրվել անօրինական միգրացիա կազմակերպելու (ՀՀ քրեական օրենսգրքի 329.1 հոդված), կաշառք ստանալու (ՀՀ քրեական օրենսգրքի 311 հոդված), կաշառք տալու (ՀՀ քրեական օրենսգրքի 312 հոդված) և կաշառքի միջնորդության (ՀՀ քրեական օրենսգրքի 313 հոդված) համար:
Վերոնշյալ երևույթները վերահսկելու և կանխելու նպատակով ՀՀ ԱԱԾ-ն ներկայումս ակտիվ համագործակցում է բոլոր այն երկրների իրավապահ մարմինների հետ, որոնց տարածքներում գտնված անձինք առնչակից են եղել բացահայտված անդրազգային հանցագործությանը։
Կեղծիքների վրա հիմնված նման գործարքներից, նյութական միջոցների կորստից, ինչպես նաև անցանկալի այլ հետևանքներից քաղաքացիներին զերծ պահելու նպատակով ՀՀ Ազգային անվտանգության ծառայությունը իրազեկում է, որ ՀՀ քաղաքացիները հետխորհրդային երկրների տարածքներում տեղակայված Շենգենյան համաձայնության երկրների դեսպանություններից մուտքի արտոնագրեր կարող են ստանալ միայն տվյալ երկրում օրինական բնակության իրավունքի ապացույց ներկայացնելու և դեսպանություն առնվազն մեկ անգամ անձամբ այցելելու դեպքում:

ՀՀ ԱԱԾ-ն նաև նախազգուշացնում է տուրիստական գործունություն իրականացնող անձանց և կազմակերպություններին՝ ձեռնպահ մնալ կեղծիքների հիման վրա մուտքի արտոնագրեր ձեռք բերելու եւ իրացնելու սխեմաներին մասնակցելուց, քանի որ նման գործողությունները կարող են պարունակել քրեորեն հետապնդելի արարքների հատկանիշներ։

Ծանուցում. Հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղքն ապացուցված չէ օրենքով սահմանված կարգով՝ դատարանի օրինական ուժի մեջ մտած դատավճռով:
