Վարչախմբի դեմքը. տմարդի արդարադատություն

Սոցիալական ցանցերը երեկվանից ցնցվում են, դատավորը երեք ամսով կալանավորել է երիտասարդ մի կնոջ, որը երեք փոքրիկ երեխա ունի, փոքրն էլ մի քանի ամսական է։ Փաստաբան Զարուհի Փոստանջյանը, կնոջ փոքրիկը գրկին, պատմում էր, որ Արշակ Մաթևոսյանը կալանքի որոշում է կարդացել։ Որոշումը լսելուն պես կինը խուճապի էր մատնվել, աղիողորմ արտասվում էր, խնդրում, որ կալանք չկիրառեն, քանի որ երեխաները խնդիրներ են ունենալու։

Ընդ որում, գործը բոլորովին էլ քաղաքական կամ անգամ, ծանր քրեական չէ։ Ըստ «Դատալեքս»-ի նյութերի՝ Լիանա Հարությունյանն օժանդակել է «Անանիա Շիրակացի» միջազգային հարաբերությունների համալսարանի ռեկտոր Վաղարշակ Մադոյանին և պրոռեկտոր Դավիթ Մադոյանին: Նրանք էլ, ըստ մեղադրանքի, իրենց իշխանական կամ ծառայողական լիազորությունների օգտագործմամբ, Հնդկաստանի Հանրապետության քաղաքացի Գուրվինդեր Կումարի, քրեական վարույթով դեռևս չպարզված երկու հոգու հետ, շահադիտական դրդումներից ելնելով, նախնական համաձայնությամբ, խմբի կազմում, միմյանց գործողությունները փոխլրացնելով՝ կազմակերպել են Հնդկաստանի 16 քաղաքացիների անօրինական միգրացիան:

Կալանավորված կինն ընդամենը թարգմանչական աշխատանք է արել, և կալանքի որոշումը բացարձակ անտեղի էր։ Առավել ևս, որ տեղեկացրել էր դատարանին, որ չի կարող մի քանի նիստի գալ։ Այս պահին կալանավորվածը «Աբովյան» քրեակատարողական հիմնարկում է, իսկ հանրությունը, ընդդիմադիր, թե իշխանամետ, զայրացած հիշում է դատավորի ողջ ազգուտակին։ Թեպետ, կան որոշ կերպարներ, որ վարչախմբին իրենց հավատարմությունը ցուցադրելու համար, նույնիսկ այս դատական որոշումն են արդարացնում։

Ֆորմալ առումով, միգուցե և, օրենքի տառը պահանջում է կալանավորել երիտասարդ, ծանր հանցանք չկատարած կնոջը, բայց օրենքի ոգին, իրական արդարադատությունը, պարզապես տղամարդկությունն ու մարդկությունը դատավորի արարքի մեջ միայն ամենավատ դրսևորումները կտեսնեն։ Ահա այսպիսի դատավորներով է Փաշինյանը համալրում դատական համակարգը (Մաթևոսյանը դատավոր է նշանակվել 2021 թ.)՝ զուրկ մարդկային դեմքից։ Նման դատավորներն են, որ հանուն պաշտոնի, անգամ մանկահասակ երեխաներին չեն խնայի։
