«Կնոջը 8 ամսական երեխայի հետ պետք է տեղափոխեն կալանավայր». ինչու է 3 ամսով կալանավորվել 3 անչափահաս երեխաների մայրը. ինչ են արձագանքում ՄԻՊ-ից (տեսանյութ)

Այսօր փաստաբան Զարուհի Փոստանջյանը տեսանյութ էր հրապարակել դատարանից, որտեղ 3 երեխաների մոր նկատմամբ դատավորը 3 ամսվա կալանքի որոշում կայացրեց:

Տեսանյութում կինն արտասվում է ու ասում, որ իր երեխաներն առանց իրեն չեն կարողանա ապրել։

Կինը՝ Լիանա Ժուլիվերի Հարությունյանը, մեղադրվում է ՀՀ քրեական օրենսգրքի 470 հոդվածով նախատեսված անօրինական միգրացիայի կազմակերպման օժանդակության համար:

Օժանդակել է Հնդկաստանի 16 քաղաքացու ապօրինի միգրացիայի կազմակերպմանը:

Դատավորը կալանքի որոշումը կայացրել է այն բանի համար, որ կինը դատական նիստերից մեկին չի մասնակցել:

Tert.am-ը դիմել է ՄԻՊ գրասենյակ՝ հասկանալու համար ՄԻՊ-ն այստեղ ինչ անելիք ունի:

«Տեսանյութն ուսումնասիրել ենք: Տեսանյութից պարզ է դառնում, որ դատարանի որոշմամբ քաղաքացու նկատմամբ կիրառվել է կալանք: «Մարդու իրավունքների պաշտպանի մասին» ՀՀ Սահմանադրական օրենքով՝ Պաշտպանն իրավասու չէ միջամտելու դատական վարույթին կամ դատավորների լիազորությունների իրականացմանը կոնկրետ գործով: Այնուամենայնիվ, քաղաքացու իրավունքների, այդ թվում՝ երեխայի խնամքի հետ կապված, Պաշտպանի հանձնարարությամբ արդեն իսկ քայլեր են ձեռնարկվում»,- ասացին ՄԻՊ գրասենյակից:

Դեպքի մասին ֆեյսբուքյան գրառում է  կատարել «Հայաստան» խմբակցության պատգամավոր Էլինար Վարդանյանը, ով տեղեկացրել է, որ գործով անցնող մյուս մեղադրյալները կալանավորված չեն:

Էլինար Վարդանյանը մասնավորապես գրել է.

«Երեք երեխաների (փոքրը ութ ամսական է) մայր այս կինը մեղադրվում է ՀՀ քրեական օրենսգրքի 470 հոդվածով նախատեաված անօրինական միգրացիայի կազմակերպման օժանդակության համար: Շուրջ 1 տարի թարգմանություն կատարելու համար նա հարցաքննվել է որպես վկա, հետո, իրավաբան գործընկերներս ինձ լավ կհասկանան, շըրըխկ, և արդեն մեղադրյալ է:

Գործը նախնական դատաքննության փուլում է: Դատարանը, որպես խափանման միջոց ընտրել է տնային կալանքը, սակայն քանի որ կինն ապրում է վարձակալած տանը, սեփականատերը հրաժարվել է թույլ տալ իր տանը կրի տնային կալանքը: Իսկ դատարանն ինչ է անում դրա փոխարեն, էլի, շըրըխկ և 3 ամսով կալանք: Հիմա այս կնոջը 8 ամսական երեխայի հետ պետք է տեղափոխեն կալանավայր, ուրիշի հոգացությանը չի կաչող թողնել:

Մի կարևոր հանգամանք ևս, գործով անցնող մյուս մեղադրյալները կալանավորված չեն:
