Տեսանյութ․ Դատախազները համարձակ ձեւով պետք է հրաժարվեն. ապօրինի գույքի բռնագանձման գործով աննախադեպ որոշում

Ապօրինի ծագում ունեցող գույքի բռնագանձման գործով «Էմ Ջի Էմ Փարտներս» ընկերությունը ուշագրավ հաջողության է հասել։

Վճիռը կայացվել է «Ապօրինի ծագում ունեցող գույքի բռնագանձման մասին» օրենքի սահմանադրականության հարցի վերաբերյալ Սահմանադրական դատարանի 16.04.2025թ. թիվ ՍԴՈ-1776 որոշումից հետո՝ դրա օբյեկտիվ և ճիշտ կիրառմամբ։

Հակակոռուպցիոն դատարանի քաղաքացիական գործեր քննող դատավոր Նարինե Ավագյանը, վճիռ է կայացրել՝ մերժելով ՀՀ գլխավոր դատախազության կողմից ներկայացված հայցն ամբողջությամբ: Դատարանը ապահովել է ապօրինի ծագում ունեցող գույքի բռնագանձման վարույթով փաստաբան Արմեն Հարությունյանի վստահորդի և նրա հետ փոխկապակցված անձանց արդար դատաքննության և դատական պաշտպանության իրավունքները։

Վերջինիս վստահորդի գույքի ուսումնասիրությունը սկսվել է այն հիմքով, որ նա ներգրավված է եղել քրեական գործով որպես մեղադրյալ և վերջինիս մեղագրվել է կոռուպցիոն բնույթի հանցագործության կատարում։ Սակայն որոշ ժամանակ անց մեղադրանքը փոփոխվել է, և նոր մեղադրանքը ընդգրկված չի եղել կոռուպցիոն բնույթի հանցագործությունների շրջանակում, որի հիմքով կարելի էր սկսել ուսումնասիրություն և ապօրինի գույքի բռնագանձման գործընթաց։

Ստացվել է այնպես, որ թեև ուսումնասիրությունը սկսվել է համապատասխան հիմքի առկայության պայմաններում, սակայն ապօրինի ծագում ունեցող գույքի բռնագանձման հայց ներկայացնելու պահին օրենսդրական հիմքն արդեն վերացած է եղել։

«Էմ Ջի Էմ Փարթներս» ընկերության փաստաբան Արմեն Հարությունյանը դատարանում նշել է, որ նման պայմաններում ՀՀ գլխավոր դատախազությունն իրավունք չուներ սկսել ուսումնասիրություն և այնուհետև ներկայացնել գույքի բռնագանձման պահանջ։

Դատարանը իրավաչափ է գնահատել ներկայացված փաստարկները՝ ընդգծելով, որ դրանք համապատասխանում են Սահմանադրական դատարանի որոշմանն այն մասով, որ պետք է առկա լինի կապ անձի ենթադրյալ հանցավոր վարքագծի և բռնագանձվող գույքի միջև, ինչպես նաև պետք է առկա լինի հանցավոր վարքագծից հնարավոր տնտեսական օգուտներ ստանալու օբյեկտիվ հնարավորություն։
