Դատախազությունը քրեական վարույթ կնախաձեռնի՞. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Այս օրերին հանրությունը կանխատեսելիորեն չափազանց ակտիվ արձագանքում է Նիկոլ Փաշինյանի ու նրան առնչակցվող անձանց կողմից Հայ առաքելական եկեղեցու դեմ նոր հարձակումներին: Ամենատարբեր նահատականներ, հակադարձումներ, շատ մեղմ ասած՝ կոշտ արտահայտություններ են հնչում ինչպես առանձին անհատների, հոգևորականների, այնպես էլ քաղաքական, հասարակական շրջանակների կողմից:

Բայց, բացի բարոյական, քաղաքական և այլ գնահատականներից, կան տեսակետներ, որ Եկեղեցու դեմ այս հարձակումները պետք է քրեաիրավական շարունակություն ստանան: Օրինակ՝ «Հինգ իրավապաշտպանների նախաձեռնությունը» այստեղ տեսնում է Սահմանադրական կարգի տապալման նախապատրաստություն, քանի որ պետությունից Եկեղեցու անջատ կարգավիճակը ՀՀ Սահմանադրական կարգի հիմունքներից մեկն է: Նաև «Հայաքվե» միավորումն է տեսնում սահմանադրական հիմունքների ոտնահարում մի քանի կետերով: Ընդ որում, մատնաշված բոլոր այդ խախտումները քրեորեն պատժելի արարքներ են: Այսինքն, եթե հրապարակայնորեն կատարվում է առերևույթ խախտում, ապա երկրի իրավապահ համակարգը պետք է արձագանքի, առնվազն՝ քննություն սկսի:

Ի լրումն, Փաշինյանի ընտանիքի անդամի կողմից հնչեցվել են մանկապղծության մասին ծանրագույն մեղադրանքներ, որոնք ևս ենթադրում են քրեաիրավական գնահատական և կոնկրետ շարունակություն: Բայց այդ մասով էլ առայժմ ձայնծպտուն չկա պատկան մարմինների կողմից:

Իհարկե, միամտություն կլիներ կարծել, որ թեկուզ ձևականորեն անկախ համարվող կառույցները իրենց նախաձեռնությամբ ինչ-որ քննություն կսկսեն հենց նշված ակնհայտ հիմքերով: Ուստի, կան կարծիքներ ու ոչ միայն կարծիքներ, որ արձանագրված հոռի երևույթը իրավական առումով դիտարկող հասարակական շրջանակները կարող են իրենք նախաձեռնել, դիմել պատկան մարմիններին, որպեսզի հարցը նման շարունակություն ստանա: Օրինակ՝ ինչպես տեղեկացրեց «Հայաքվե» միավորման համակարգող Ավետիք Չալաբյանը, միավորումը Նիկոլ Փաշինյանի հայտարարությունների հիման վրա հանցագործության մասին հաղորդում է ներկայացրել գլխավոր դատախազությանը:

Երեկ «Փաստը» դիմեց գլխավոր դատախազություն՝ փորձելով պարզել, թե ինչ ընթացք է տրվել այդ հաղորդմանը: Դատախազությունից խնդրեցին գրավոր հարցում, որն ուղարկել ենք, և պատասխանն ստանալուն պես կներկայացնենք:
