Հանցավոր կազմակերպության անդամները զանգերի կենտրոնի միջոցով հափշտակել են առանձնապես խոշոր չափերով գումար

ՀՀ քննչական կոմիտեի հատկապես կարևոր գործերի քննության գլխավոր վարչության կիբեռհանցագործությունների և բարձր տեխնոլոգիաների ոլորտում կատարված հանցագործությունների քննության վարչությունում քննվող քրեական վարույթի նախաքննության ընթացքում առերևույթ փաստական տվյալներ են ձեռք բերվել այն մասին, որ մի խումբ անձինք 2023 թվականի դեկտեմբերից 2024 թվականի հոկտեմբերն ընկած ժամանակահատվածում մասնակցել են Դ.Ս.-ի և Տ.Դ.-ի կողմից ղեկավարվող հանցավոր կազմակերպությանը: Հայտնում են ՔԿ-ից:

Մասնավորապես՝ հանցավոր կազմակերպության անդամները ձեռք բերելով ներդրումային խարդախություններից տուժած անձանց տվյալները՝ ստեղծել են զանգերի կենտրոն, աշխատանքի ընդունված անձանց միջև կատարել դերաբաշխում, զանգահարել ցուցակում ընդգրկված տուժած անձանց և ներկայանալով իբրև միջազգային կազմակերպության ներկայացուցիչ՝ համոզել են վերջիններիս, թե ունեն հնարավորություն վերականգնելու պատճառված վնասը և ապահովելու հափշտակված միջոցների ստացումը՝ համոզելով գումարներ փոխանցել իրենց կողմից կառավարվող տարբեր կրիպտոդրամապանակների հաշիվներին:

Արդյունքում, հանցավոր կազմակերպության անդամների կողմից կառավարվող այլ կրիպտոդրամապանակներին փոխանցվել է առանձնապես խոշոր չափերով՝ ընդհանուր 16 մլն 94 հզր 945 ՀՀ դրամ գումար:

Բացի այդ, 2024 թվական ապրիլից հոկտեմբերն ընկած ժամանակահատվածում նույն եղանակով շուրջ 61 անձից հափշտակելով առնվազն 1000-ական ԱՄՆ դոլար գումար՝ կատարել են առնվազն 23 մլն 613 հզր 710 ՀՀ դրամ գումարի չափով համակագչային հափշտակություն:

Դ․Ս․-ի, Տ․Դ․-ի նկատմամբ հարուցվել է հանրային քրեական հետապնդում՝ Քրեական օրենսգրքի 318-րդ հոդվածի 1-ին մասով (հանցավոր կազմակերպություն ստեղծելը կամ ղեկավարելը) և 257-րդ հոդվածի 3-րդ մասի 1-ին և 3-րդ կետերով (առանձնապես խոշոր չափերով համակարգչային հափշտակությունը), մեկ անձի նկատմամբ՝ 319-րդ հոդվածի 1-ին մասով (hանցավոր կազմակերպությանը մասնակցելը), 257-րդ հոդվածի 3-րդ մասի 1-ին և 3-րդ կետերով (առանձնապես խոշոր չափերով համակարգչային հափշտակությունը) և 238-րդ հոդվածի 3-րդ մասի 1-ին և 2-րդ կետերով (անչափահասին հանցանքի կատարմանը հակելը կամ դրան մասնակից դարձնելը), չորս անձի նկատմամբ՝ 319-րդ հոդվածի 1-ին մասով (hանցավոր կազմակերպությանը մասնակցելը), 257-րդ հոդվածի 3-րդ մասի 1-ին և 3-րդ կետերով (առանձնապես խոշոր չափերով համակարգչային հափշտակությունը)։

Հինգ անձի նկատմամբ որպես խափանման միջոց կիրառվել է կալանքը, իսկ երկու անձի նկատմամբ՝ տնային կալանքը:

Քրեական վարույթը մեղադրական եզրակացությամբ ուղարկվել է հսկող դատախազին։

Ծանուցում. հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ Քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
