Ի՞նչ է տասն օրից ավելի քննարկում ՍԴ-ն. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Սահմանադրական դատարանը վերսկսել է «Ապօրինի ծագում ունեցող գույքի բռնագանձման մասին» օրենքի՝ Սահմանադրությանը համապատասխանության հարցը որոշելու վերաբերյալ գործի քննությունը և տասն օրից ավելի է՝ գտնվում է խորհրդակցական սենյակում:

«Փաստը» երեկ դիմեց ՍԴ հանրային կապերի բաժին՝ տեղեկանալու՝ կա՞ն տեղեկություններ, թե ե՞րբ կհրապարակվի որոշումը: Մեզ տեղեկացրեցին, որ դեռևս նորություն չկա, և հստակ ժամկետ նշել չեն կարող, երբ որոշումը պատրաստ լինի, կհրապարակվի ՍԴ պաշտոնական էջում:

Հիշեցնենք, որ 2020 թվականին, երբ ընդունվեց «Ապօրինի ծագում ունեցող գույքի բռնագանձման մասին» աղմկահարույց օրենքը, ոլորտի բոլոր մասնագետները պնդում էին, որ այն ընդունվել է միջազգային փորձում առկա պահանջների ակնհայտ ու կոպիտ խախտմամբ: Չնայած նման կարևոր օրենքները, նախքան ընդունումը, համաձայն միջազգային փորձի, նախ փոխանցվում են Վենետիկի հանձնաժողով՝ հեղինակավոր այդ կառույցի կարծիքը ստանալու համար, բայց օրվա իշխանությունները խուսափել էին դրանից և չէին ուղարկել օրենքի նախագիծն այդ մարմին:

Երբ օրենքը սկսեց կիրառվել, ակնհայտ դարձավ, որ բոլոր մտահոգություններն իրականություն են դառնում՝ այն չի վերաբերում զուտ նախկին պաշտոնյաներին, այլ ցանկացած անձի, նույնիսկ գործարարների: Ավելին, այդ բռնագանձվող միջոցները ոչ թե փոխանցվում էին ժողովրդին, այլ պարզապես ուրիշ գործարարների տնօրինման տակ էին հայտնվում: Որոշ ժամանակ անց այս օրենքի հարցն առկախվել էր Սահմանադրական դատարանում։ Եվ միայն 4 տարի անց Սահմանադրական դատարանը, ձեռքի տակ ունենալով Վենետիկի հանձնաժողովի խորհրդատվական կարծիքը, Եվրոպական դատարանի Մեծ պալատի կայուն նախադեպային որոշումները, ըստ որոնց՝ այս օրենքը մի շարք խախտումներ է պարունակում, փաստացի վերսկսել է գործի քննությունը:
