Նոր հարկեր, տուգանքի նոր «մատերիալ». «Փաստ»

«Փաստ» օրաթերթը գրում է.

ՀՀ կառավարությունը որոշել է կիրառել դեռևս 2022 թ. ձմռանը Հարկային օրենսգրքում իրականացրած օրենսդրական փոփոխությունները և լրացուցիչ հարկ գանձել կառուցապատող ընկերություններից։ Օրենքի էությունն այն է, որ դեռևս անավարտ՝ կառուցման փուլում գտնվող շինությունների համար առաջադրում են գույքահարկ վճարելու պարտավորություն՝ սկզբնական շինթույլտվության ժամկետի ավարտից կամ այդ ժամկետի երկարաձգման փուլից սկսած։ Այսինքն, եթե կառուցապատող ընկերությունը երկարաձգել է շինթույլտվության ժամկետները, միևնույն է՝ նա պարտավոր է վճարել դեռևս չկառուցված շենքի գույքահարկը։

Հատկանշական է, որ թեև օրենսդրական փոփոխությունն ուժի մեջ է մտել 2023 թ. հունվարի 1-ից, բայց մինչ օրս այդ օրենքը չի կիրառվել։ Փոխարենը Երևանի քաղաքային իշխանությունները կառուցապատող ընկերությունների համար տեղական տուրքերի և վճարների նոր՝ ահռելի բարձր դրույքաչափեր են սահմանել, ինչպես նաև աննախադեպ աստիճանի բարձրացրել են շինթույլտվություններ տրամադրելու և դրանց ժամկետը երկարաձգելու գինը։ Երկու այս փոփոխությունների նպատակն էլ տնտեսվարողներին իբր ստիպելն էր, որ շինաշխատանքները ժամանակին ավարտին հասցնեն և կիսատ չթողնեն։

Փաստորեն միևնույն խնդիրը լուծելու պատրվակով իշխանությունները երկու գործիք (իսկ իրականում՝ պատժամիջոց) են մշակել, որոնցից մեկն արդեն գործում է, իսկ մյուսը՝ մինչ այս տարվա մարտի 1-ը առկախված մնացել։ Բայց փաստորեն կառավարությանը նոր գումարներ են անհրաժեշտ, և նրանք որոշել են ստուգել բիզնեսը հարկման «մատերիալի» վերածելու իրենց զինանոցները, տեսնել, թե էլ ինչպես կարելի է գումար գանձել Հայաստանում գործող բիզնեսներից և գործի դնել նաև երկրորդ պատժամիջոցը։

Դեռևս չկառուցված շենքի համար գույքահարկ պահանջելու օրենքը մեծ սպառնալիք է դարձել կառուցապատող ընկերությունների համար։ Նրանցից շատերը կարող են կանգնել սնանկացման վտանգի առջև՝ մուլտիպլիկատիվ բացասական էֆեկտ առաջացնելով շուկայի բազում այլ ոլորտների, օրինակ՝ բանկային համակարգի համար։ Էլ չենք խոսում իրենց բնակարաններին սպասող բազում քաղաքացիների մասին, որոնք կարող են պարզապես ձեռնունայն մնալ՝ համալրելով իշխանությունների քայլերից տուժած հարյուր հազարավոր քաղաքացիների շարքերը։

Ի՞նչ պետք է անեն առանց այն էլ տասնյակ և հարյուրավոր միլիոն դրամ չնախատեսված տեղական տուրքեր և տարատեսակ վճարներ վճարող կառուցապատողներն այս իրավիճակից դուրս գալու համար։ Դժվար է ասել։ Թերևս շատերը կա՛մ ստիպված կլինեն դադարեցնել իրենց գործունեությունը, կա՛մ սնանկանան, կա՛մ էլ դժվարությունները շրջանցելու ուղիներ որոնեն։ Մինչդեռ մեր երկրի՝ Սահմանադրությամբ ապահովագրված պարտավորություններից են գործարար միջավայրի բարելավումը, բնակարանային շինարարության խթանումը և այլն։

Թե բա՝ քաղաքացին տուգանքի մատերիալ չէ...
