Դատական համակարգն աղավաղողը խոսում է արդարադատությունից

«Պետք է հասնենք նրան, որ արդարությունն ու արդարադատությունը, ճշմարտությունը և արդարադատությունը, օրինականությունը, արդարադատությունը և ճշմարտությունը լինեն հոմանիշներ»,- ուշագրավ այս մտքի հեղինակը ոչ այլ ոք է, քան Նիկոլ Փաշինյանը, որը նախօրեին մասնակցել է Հայաստանի դատական իշխանությանը նվիրված միջոցառմանը, ծավալուն ելույթ ունեցել։

Տարօրինակն այս ամենում օրերս Փաշինյանի արած մեկ այլ հայտարարությունն էր, թե Հայաստանը պատրաստ է փոխադարձ հրաժարվել Ադրբեջանի նկատմամբ առաջադրված պահանջներից, ներառյալ բայց ոչ միայն միջազգային դատական ատյաններում։ Փաստացի, արդարության ու արդարադատության մասին ճամարտակում է մի անձ, ով տակավին մի քանի օր առաջ չի բացառում Ադրբեջանի կատարած ռազմական հանցագործությունների համար պատասխանատվություն պահանջելու իրավունքից։

Նույն այդ Փաշինյանն իր պաշտոնավարման ողջ ընթացքում հնարավոր բոլոր քայլերն արել է Հայաստանում դատաիրավական համակարգը խեղաթյուրելու, մերձավորներին պատասխանատվությունից ազատելու, համակարգն էլ ընդդիմախոսներին պատժելու գործիքի վերածելու համար։ Փոխարենը, մինչ օրս բացահայտված չեն ոչ Հոկտեմբերի 27-ը, ոչ Մարտի 1-ը, մեղավորները պատժված չեն, իսկ ապօրինի գույքի բռնագանձման գործերն ավելի շուտ ընդդիմադիրների դեմ հաշվեհարդար, քան արդարադատություն են հիշեցնում։

«Կառավարությունն ինչ ծրագիր էլ իրագործի, տնտեսական ինչ բանաձև էլ ներդնի, որևէ բանաձևի իրագործում հնարավոր չէ, եթե չկա անկախ դատական համակարգ, եթե չկա դատական այնպիսի համակարգ, որը վստահություն է ներշնչում յուրաքանչյուր քաղաքացու, յուրաքանչյուր տնտեսվարող սուբյեկտի մոտ»,- ասել է Փաշինյանը՝ հերթական անգամ ակնարկելով, որ դատական համակարգը շարունակելու է գործադիրի կցորդի վերածելու իր քաղաքականությունը։
