Հայաստանի Սահմանադրական դատարանի վերջին որոշումն էլ ավելի է բարդացրել հարցը. Բայրամով

Հայաստանի հետ խաղաղության պայմանագրի նախագիծը ներառում է 17 կետ, որից 15-ն արդեն համաձայնեցված է, մյուս 2 կետի շուրջ աշխատանքները շարունակվում են, ասել է ադրբեջանի ԱԳ նախարար Ջեյհուն Բայրամովը:

«Նախաբանի տեքստը և 15 կետերը գրեթե ամբողջությամբ համաձայնեցված են: Իսկ 2 կետերի շուրջ մենք բաց հարցեր ունենք. դրանց վրա աշխատանքները շարունակվում են։ Արդեն եղել է բանակցությունների և տեքստերի փոխանակման մի քանի փուլ։ Լիովին համաձայնեցված տարբերակի դեռ չի հաջողվել հասնել։ Աշխատանքը շարունակվում է», - ասել է Բայրամովը։

Միևնույն ժամանակ նա ասել է, որ «խաղաղության հասնելու գործընթացը բարդացնում է Հայաստանի Սահմանադրությունը, որը տարածքային պահանջներ է պարունակում Ադրբեջանի նկատմամբ»:

«Մենք համաձայն չենք այն փաստարկների հետ, որոնք Հայաստանը ներկայացնում է վերջին շրջանում։ Հայաստանի Սահմանադրական դատարանի վերջին որոշումը էլ ավելի է բարդացրել իրավիճակը։ Մասնավորապես, որոշում է կայացվել Հայաստանի Սահմանադրության նախաբանի անփոփոխելիության մասին։ Հենց նախաբանում անդրադարձ է կատարվում անկախության հնչակագրին, որն իր հերթին պարունակում է տարածքային պահանջներ Ադրբեջանի դեմ», - նշել է նա:

Բայրամովի խոսքով՝ հետպատերազմական շրջանում Ադրբեջանն ու Հայաստանը շարունակել են խաղաղության շուրջ բանակցությունները և կարծիքների փոխանակումը խաղաղության պայմանագրի տեքստի շուրջ:

«Ադրբեջանի և Հայաստանի միջև բանակցությունները շարունակվում են խաղաղության պայմանագրի շուրջ, շարունակվել են տեքստային փոխանակումները և այստեղ, չնայած բաց հարցերին, ակնհայտ առաջընթաց է գրանցվել», - նշել է նա:

Հայաստանի Հանրապետության Սահմանադրական դատարանը 2024-ի սեպտեմբերի 26-ի որոշման մեջ նշվում է, որ Սահմանադրության նախաբանում Անկախության հռչակագրի հղումը վերաբերում է բացառապես հռչակագրի այն դրույթներին, որոնք ամրագրված են Սահմանադրության հոդվածներում։

«ՀՀ Սահմանադրության ոչ մի դրույթ տարածքային պահանջներ չի պարունակում հարևան երկրների նկատմամբ»,- որոշման հրապարակումից հետո պնդել էր Հայաստանի վարչապետ Նիկոլ Փաշինյանը:
