Իշխանությունները նորից նույն փոցխի վրա են կանգնում. «Փաստ»

«Փաստ» օրաթերթը գրում է.

2018 թվականի իշխանափոխությունից հետո Նիկոլ Փաշինյանի առաջին քայլերից մեկը եղավ Մարտի 1-ի գործով քրեական գործ հարուցել տալ ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի նկատմամբ, որը փաստացի 2,5 տարի գտնվում էր մեղադրյալի կարգավիճակում, ավելին՝ շուրջ 530 օրը գտնվել է անազատության մեջ: Եվ ահա, նախ՝ Սահմանադրական դատարանը հակասահմանադրական ճանաչեց Քրեական օրենսգրքով նախատեսված հոդվածը, որով գործ էին հարուցել և մեղադրում էին Ռոբերտ Քոչարյանին, 2008-ին պաշտպանության փոխնախարար Յուրի Խաչատուրովին և Զինված ուժերի գլխավոր շտաբի պետ Սեյրան Օհանյանին։ Հետո Երևանի ընդհանուր իրավասության դատարանը ստիպված որոշում ընդունեց, որով քրեական գործը կարճեց, ապա և արդարացրեց Ռոբերտ Քոչարյանին և մյուսներին:

Ի սկզբանե իրավաբանները նշում էին, որ այս քրեական գործը փուչիկ է, ինչը հաստատեցին թե՛ ՍԴ-ն, թե՛ ընդհանուր իրավասության դատարանը: Այդուամենայնիվ, Նիկոլ Փաշինյանն, ինչպես երևում է, չի հանձնվում և որոշել է նույն փոցխի վրա երկրորդ անգամ կանգնեցնել իրավական համակարգը: Եվ, ահա, արդեն Հակակոռուպցիոն դատարանում վերսկսվել է նույն անունով մի դատավարություն, որի բացատրությունը, հոդվածը, մեղադրանքը այդպես էլ հասկանալի չեղավ ոչ միայն հանրությանը, այլև իրավաբաններին։ Առաջին իսկ նիստը ցույց տվեց, որ նորից գործ ունենք, ինչպես երեկ Ռոբերտ Քոչարյանը նշեց, «իրավաբանական խուլիգանության» հետ: «Այն, ինչը կատարվում է, աբսուրդի ժանրից է և ընդհանրապես կապ չունի իրավաբանության հետ»,-ասաց նա:

Բանն այն է, որ կա քրեական գործ, բայց փաստացի չկա մեղադրանք: Երեկ մեզ հետ զրույցում մի քանի իրավաբաններ նշեցին, որ այս պարագայում իշխանությունները երկու ճանապարհ ունեն՝ կա՛մ հրատապ կարճել գործը, ինչը նշանակում է նորից խայտառակ լինել, կա՛մ շարունակել խախտել ՀՀ օրենքները և գնալ «մինչև վերջ»՝ չխորշելով հերթական ապօրինություններից, և խայտառակվել ամեն հերթական նիստի ընթացքում, այնքան երկար, որքան հնարավոր կլինի «ձգել» այս գործը:
