ՍԴ-ն երբևէ իրավասու չէ «խժռել» Հայաստանի անկախության մասին հռչակագիրը

Սահմանադրական դատարանի որևէ կազմ, որևէ ժամանակահատվածում իրավասու չէ «խժռել» Հայաստանի անկախության մասին հռչակագիրը։ Այս արձանագրումն արել է Սահմանադրական դատարանի դատավոր Հրայր Թովմասյանը, ով միակն էր, որ դեմ էր քվեարկել Սահմանազատման հանձնաժողովների կանոնակարգի ընդունմանը։ Թովմասյանը նշում է, թե Հայաստանի և Ադրբեջանի միջև պետական սահմանի Սահմանազատման հանձնաժողովի կանոնակարգի վերաբերյալ ՀՀ Սահմանադրական դատարանի եզրակացությունը բազմաթիվ իրավական և քաղաքական ռիսկեր ու սպառնալիքներ է պարունակում ՀՀ պետականության համար։

ՍԴ նախկին նախագահը, որին հեռացնելու համար Նիկոլ Փաշինյանն ու իր թիմն ահռելի ճնշումներ են գործադրել, ընդհուպ դատարանով անհեթեթ մեղադրանք առաջադրել, մեղադրական վճիռ կայացրել, որպեսզի ուժի մեջ մտնելուց հետո նրան զրկեն դատավորի պատմուճանից, ուշադրություն է հրավիրել ՍԴ եզրակացության այն կետի վրա, ըստ որի՝ դատարանը փաստացի իրավական ուժ չունեցող է ճանաչել Անկախության հռչակագրի հղումը Սահմանադրության նախաբանում։ Ըստ նրա` Սահմանադրական դատարանն արժեզրկել է Հայաստանի անկախության մասին հռչակագրի նորմատիվային նշանակությունը` վերածելով այն սոսկ խորհրդանշական փաստաթղթի։ «Գտնում եմ, որ Հայաստանի անկախության մասին հռչակագրի՝ նորմատիվային բնույթի անտեսումը կարող է վտանգել անկախացման գործընթացի լեգիտիմությունը և հանգեցնել ներկայիս Հայաստանի Հանրապետության համար գոյաբանական վտանգների ավելացմանը»,– գրել է Թովմասյանը՝ նկատելով, որ Հայաստանի և Ադրբեջանի միջև պետական սահմանի Սահմանազատման հանձնաժողովի կանոնակարգն առհասարակ ենթակա չէր Ազգային ժողովի կողմից վավերացման, հետևաբար՝ չէր կարող դառնալ Սահմանադրական դատարանի քննության առարկա։

Համեմատելով ՍԴ կայացրած ոչ իրավաչափ որոշումն ու Թովմասյանի հատուկ կարծիքը, կարելի է փաստել, որ դատավորը միակն է, ով կապ ունի իրավաբանության հետ։ Թեպետ, այս պարագայում դա քիչ բան է փոխում, գործող իշխանությունն ամեն ինչ արել և անելու է Ադրբեջանի պահանջները կատարելու համար, այդ թվում՝ ՍԴ դատավորներին իրեն հանցակից դարձնելու ճանապարհով։
