500 000 ԱՄՆ դոլարի զարդերի և 4000 ԱՄՆ դոլար գումարի հափշտակության դեպք․ 72-ամյա կինն ու 21-ամյա թոռը

ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչության Քանաքեռ-Զեյթուն վարչական շրջանի քննչական բաժնի քննիչների և Ոստիկանության ծառայողների հետ համատեղ իրականացված միջոցառումների արդյունքում բացահայտվել է Երևան քաղաքի 72-ամյա բնակչուհու բնակարանից առանձնապես խոշոր չափերով հափշտակություն կատարելու դեպքը: Այս մասին տեղեկացնում են ՔԿ-ից:

«Նախաձեռնված քրեական վարույթով առաջ են քաշվել աշխատանքային վարկածներ, ձեռնարկվել անհետաձգելի գործողություններ, որոնց արդյունքում պարզվել են քննության համար էական նշանակություն ունեցող հանգամանքներ, այդ թվում՝ հանցագործություն կատարած երկու անձանց ինքնությունը, որոնցից մեկը 72-ամյա կնոջ քրոջ 21-ամյա թոռն է, իսկ մյուսը՝ վերջինիս 24-ամյա ընկերը:

Քննությամբ բավարար փաստական տվյալներ են ձեռք բերվել այն մասին, որ 21-ամյա երիտասարդը, տեղյակ լինելով իր մոր մորաքրոջ՝ տանից տևական ժամանակ բացակայելու և բնակարանի բանալիների օրինակը իրենց բնակարանում գտնվելու հանգամանքի մասին, ուրիշի գույքը հափշտակելու նպատակով, 72-ամյա կնոջը պատկանող, սակայն իր կողմից շահագործվող «Nissan X-Trail» մակնիշի ավտոմեքենայով հանդիպել է հիշյալ ընկերոջը և պայմանավորվել հափշտակություն կատարելու շուրջ:

2024 թվականի օգոստոսի 24-ին՝ ժամը 05:40-06:15-ն ընկած ժամանակահատվածում, երիտասարդները, նախնական համաձայնությամբ, խմբի կազմում, գույքի գաղտնի հափշտակություն կատարելու միասնական դիտավորությամբ, դռան կողպեքը բանալու միջոցով բացելու եղանակով, ապօրինի մուտք են գործել 72-ամյա կնոջ տուն և գաղտնի հափշտակել մոտ 500.000 ԱՄՆ դոլար արժողության ոսկյա և ադամանդյա զարդեր և 4000 ԱՄՆ դոլար գումար:

Այնուհետև, նպատակ ունենալով հանցանքն այլ եղանակով և իբրև այլ անձանց կողմից կատարված լինելու տպավորություն ստեղծել, ինչպես նաև՝ չբացահայտվելու, հանցանքն այլ եղանակով կատարված լինելու և քննությունը շեղելու նպատակով, մետաղյա լինգով վնասել են բնակարանի մուտքի դռան փականին հարող փայտե մակերեսը և, մետաղյա ձողը թողնելով բնակարանում, հեռացել:

Վարույթն իրականացնող մարմնի կողմից իրականացված լայնածավալ քննչական գործողությունների, ոստիկանության ծառայողների կողմից ձեռնարկված օպերատիվ-հետախուզական միջոցառումների արդյունքում այլ անձանց կողմից գողություն կատարելու իմիտացիան բացահայտվել է, հափշտակություն կատարելու համար կասկածվող նշված երիտասարդները հայտնաբերվել, ներկայացվել են վարույթն իրականացնող մարմնին և, հանցանք կատարած լինելու հիմնավոր կասկածի հիմքով, ձերբակալվել:

Նրանց մեղադրանք է ներկայացվել՝ ՀՀ քրեական օրենսգրքի 254-րդ հոդվածի 3-րդ մասի 2-րդ և 4-րդ կետերով:

Միջնորդություններ են ներկայացվել դատարան՝ վերջիններիս նկատմամբ կալանքը որպես խափանման միջոց ընտրելու մասին։ Դատարանի համապատասխան որոշումներով 24-ամյա երիտասարդի նկատմամբ որպես խափանման միջոց է ընտրվել կալանավորումը, իսկ 21-ամյա երիտասարդի նկատմամբ՝ տնային կալանքը և բացակայելու արգելքը:
