ՊԵԿ նախագահը հերքում է, թե ցանկանում են կալանավորել գործարարներին

Պետեկամուտների կոմիտեի նախագահը հերքում է տարածված տեղեկությունները, թե աղմուկ հանած օրենսդրական նախաձեռնությունը գործարարներին կալանավորելու մասին չէ, այլ հարկային կարգապահությունը բարձրացնելու նպատակ ունի։

«Սուտ է պնդումը, թե ՊԵԿ-ն ուզում է տարեկան հազար գործարարի կալանավորել»,- նշել է ՊԵԿ նախագահ Ռուստամ Բադասյանը։

Խոսելով «ՀՀ քրեական օրենսգրքում փոփոխություն և լրացում կատարելու մասին» օրենքի նախագծի մասին, Ռուստամ Բադասյանը նշել է, որ այն գործարարներին կալանավորելու մասին չէ, այլ նպատակ ունի բարձրացնելու հարկային կարգապահությունը, ինչը կնպաստի տնտեսության զարգացմանն ու կայունացմանը:

Օրերս «Մանթաշյանց» գործարարների ակումբի նախագահ Վահրամ Միրաքյանը մեղադրել էր պետեկամուտների կոմիտեին հարկային տեռորի և հակատնտեսական կոշտ քաղաքականություն վարելու մեջ։ Ըստ Միրաքյանի, ՊԵԿ-ի նախաձեռնած օրենսդրական առաջարկի հետևանքով ամեն տարի մոտ հազար գործարար կարող է հայտնվել բանտում, իսկ դա նշանակում է խաչ քաշել բիզնեսի վրա։ Խոսքը քրեական օրենսգրքի 290-րդ հոդվածի մասին է, որը 4-8 տարվա ազատազրկմամբ է սպառնում 10 միլիոն դրամ և ավելի խախտման դեպքում, նույնիսկ եթե գործարարը վճարում է հայտնաբերված խախտման գումարը։ Վահրամ Միրաքյանի խոսքով՝ Հայաստանում գործարարությամբ զբաղվելը ՊԵԿ-ը անկանխատեսելի է դարձրել, քանի որ ամեն րոպե գործարարին կարող են կալանավորել, և շատերն արդեն մտածում են ներդրում անել երկրից դուրս։

ՊԵԿ նախագահը նշում է, թե նախագիծը որևէ առնչություն չունի կալանքի հետ։ Նա նկատել է, թե վիճակագրությունը ցույց է տալիս, որ վերջին տվյալներով քննվող մոտ 1000 գործից 5 տոկոսից էլ պակաս դեպքերում է ներկայացվել կալանքի միջնորդություն, իսկ դատարանների կողմից բավարարվել է ավելի քիչ քանակով գործ, ինչն անհամեմատ ավելի քիչ է ընդհանուր գործերի քանակից: Դրանք էլ ակնհայտ քրեական տարրեր պարունակող հարկերից խուսափելու դիտավորյալ դեպքերն են, օրինակ, ավելացված արժեքի հարկի խարդախության դեպքերը: Ռուստամ Բադասյանը նկատում է, թե պետք է զգույշ լինել կալանքի մասին խոսելիս՝ ընդգծելով, որ կալանքը խափանման միջոց է, և կոմիտեն ոչինչ չի խստացնում հարկային վարչարարության մասով: «Մենք պետք է հասկանանք, թե ինչ է հարկային կարգապահությունը, ինչ տեսակի պետություն ենք ուզում ունենալ։ Պետությունից գողանալը նորմա՞լ է, թե՞ ուզում ես ունենալ առողջ տնտեսություն։ Եթե երկրորդը, հարկային կարգապահությունը պետք է պատշաճ լինի»,- նշել է Բադասյանը։

Նրա խոսքով, հսկայական ստվեր գոյություն ունի, և պետության պարտքն է պայքարել ստվերի դեմ, իսկ այդ հարցում համագործակցելու են բիզնեսի, գործարար ակումբների հետ։
