Գագիկ Խաչատրյանին բուժօգնությունից տևական զրկումը ուղղակի խոշտանգում է. փաստաբան Երեմ Սարգսյան

Այսօր՝ 2024թ. ապրիլի 30-ին, Երևան քաղաքի ընդհանուր իրավասության քրեական դատարանում տեղի ունեցավ Գագիկ Խաչատրյանի գործով հերթական դատական նիստը, որը անցկացվեց դռնփակ ռեժիմով, քանի որ դատարանը քննում էր Գագիկ Խաչատրյանի առողջական վիճակին վերաբերող հարցեր։ Գագիկ Խաչատրյանը դատարան բերվեց շտապ օգնության բրիգադի ուղեցկությամբ: Դատական նիստի ընթացքում ցավերը սաստկացել են և բժիշկները պարբերաբար ներարկումներ են կատարել Գագիկ Խաչատրյանին:


Նիստի ավարտից հետո Երեմ Սարգսյանը լրագրողների հետ զրույցում հայտնել է, որ կրկին միջնորդել է
դատարանին թույլատրել Գագիկ Խաչատրյանին բուժօգնություն ստանալ արտասահմանում:


«Մենք արդեն քանի ամիս է բարձրաձայնում ենք, անընդհատ նոր ապացույցներ, նոր բժշկական եզրակացություններ ներկայացնելով դատարանին հիմնավորում ենք մի պարզ իրողություն, որ Գագիկ Խաչատրյանին անհրաժեշտ է ստանալ բուժօգնություն, որը հնարավոր չէ ստանալ Հայաստանի Հանրապետության տարածքում։ Դատախազն ու դատարանն ասում են՝ նույն բանը` նորից ապացուցեք, նախորդ եզրակացությունը չի հավաստում այսինչ փաստը, նոր եզրակացություն բերեք և այլն։ Մինչդեռ Մարդու իրավունքների եվրոպական դատարանը Գագիկ Խաչատրյանի առողջական վիճակով պայմանավորված անհապաղ միջոցի քննարկման հարցով նշել է կալանքից ազատելու և
պատշաճ բուժօգնություն ապահովելու անհրաժեշտությունը։ Հիմա, երբ Գագիկ Խաչատրյանը կալանավորված չէ, սակայն զրկված է պատշաճ բուժօգնություն ստանալուց, ստացվում է ՄԻԵԴ որոշումը չի կատարվում, ստացվում է՝ պետությունը խոշտանգում է մարդուն»- նշել է փաստաբան Երեմ Սարգսյանը։


Փաստաբանը անդրադարձավ այս քրեական գործի մասին երեկ Գլխավոր դատախազ Աննա Վարդապետյանի
հիշատակումներին:


«Այնպիսի տպավորություն է, որ դատախազությունը յոթ երգ գիտի, յոթն էլ Գագիկ Խաչատրյանի մասին է.
դատախազին հարց են տալիս, թե ինչու է այսքան տարի կալանքի տակ պահվում Վանաձորի ընտրված քաղաքապետ Մամիկոն Ասլանյանը, դատախազն ասում է՝ բա տեսեք, թե ինչքան է ձգվում Գագիկ Խաչատրյանի գործը։ Այստեղ մեկնաբանությունները ավելորդ են. եթե համեմատվում են անհամեմատելի քրեադատավարական գործընթացներ, ապա պարզ է, որ այստեղ իրավական խոսույթի հետ գործ չունենք»։


Հիշեցնենք, որ Գագիկ Խաչատրյանը և Կարեն Խաչատրյանը մեղադրվում են պետական գործունեության ընթացքում թույլ տրված ենթադրյալ պաշտոնեական դիրքի չարաշահման, գույքի վատնման և պաշտոնեական կեղծիքի համար։


Երկուսն էլ չեն ընդունում իրենց առաջադրված մեղադրանքը, և ըստ գործում առկա ապացույցների, երբևէ փորձ չեն կատարել թաքնվել քննությունից կամ խոչընդոտել քննության ընթացքը։ Գագիկ Խաչատրյանը, 2019թ.-ին գտնվելով Գերմանիայում, քննիչի առաջին իսկ հեռախոսային կանչով ընդհատել է հետվիրահատական պարտադիր բուժումը և վերադարձել Հայաստան ու ներկայացել վարույթն իրականացնող մարմնին։ Կարեն Խաչատրյանը խափանման միջոցի՝ կալանավորման, որոշման հրապարակումից հետո անձամբ է ներկայացել դատարան։
