Հոդված 4. Տ եղական հանրաքվեի դրվող հարցերը
1. Տեղական հանրաքվեի կարող են դրվել տվյալ համայնքի բնակիչների համայնքային նշանակության հանրային
հարցերը, բացառությամբ՝
1) մարդու և քաղաքացու իրավունքներին, ազատություններին ու պարտականություններին, դրանց իրականացումն
ապահովող սահմանադրական երաշխիքների վերացմանը կամ սահմանափակմանը վերաբերող հարցերի.
2) պետության կողմից տեղական ինքնակառավարման մարմիններին պատվիրակված լիազորություններին առնչվող
հարցերի.
3) համայնքի ղեկավարի աշխատակազմի ձևավորմանը վերաբերող հարցերի.
4) համայնքի բյուջեի ընդունման կամ փոփոխման, ինչպես նաև համայնքի ֆինանսական պարտավորությունների
կատարման կամ փոփոխման մասին հարցերի.
5) համայնքի սեփականության օտարման մասին հարցերի.
6) բնակչության պաշտպանության, առողջությունն ու անվտանգությունն ապահովող արտակարգ և շտապ
միջոցառումներ ձեռնարկելու մասին հարցերի.
7) պատմության, մշակույթի, բնության հուշարձաններին և արգելանոցներին վնաս հասցնող հարցերի.
տեղական հարկերին, տուրքերին, վճարներին վերաբերող հարցերի.
9) միջհամայնքային միավորումներ ստեղծելու վերաբերյալ հարցերի.
10) այն հարցերը, որոնք արդեն իսկ դրվել են տեղական հանրաքվեի նախորդ մեկ տարվա ընթացքում և
նույնաբովանդակ են:
1.1. Կառավարության կողմից համայնքների միավորման կամ բաժանման վերաբերյալ օրենսդրական
նախաձեռնության դեպքում համապատասխան համայնքների բնակիչները համայնքների միավորման կամ բաժանման
հարցով կարող են նախաձեռնել տեղական հանրաքվե: Համայնքի միավորման կամ բաժանման հարցով անցկացված
տեղական հանրաքվեի արդյունքները կրում են խորհրդատվական բնույթ:
2. Տեղական հանրաքվեով ընդունված ակտը կարող է փոփոխվել միայն տեղական հանրաքվեով
