Հայաստանի դատական համակարգը չունի բավարար չափով անկախություն, Հայոց ազգային արժանապատվության տրիբունալի ստեղծումն այօրվա հրամայականն է. Արշակ Կարապետյան

Հայոց ազգային արժանապատվության տրիբունալը դեռ լիարժեք չի ստեղծվել, բայց արդեն ցնցել է գործող իշխանությունների հիմքերը։ Մեզ հասած տեղեկություններով՝ Փաշինյանական վարչախումբն այնքան է ահաբեկվել այս նոր նախաձեռնությունից, որ ընդհուպ հանձնարարություններ է իջեցրել քննչական կոմիտեին և դատախազությանը՝ նյութեր նախապատրաստել քրեական գործ հարուցելու համար։

Ինչպես և սպասելի էր, «Համահայկական ճակատ» շարժման առաջնորդ, պաշտպանության նախկին նախարար, գեներալ-մայոր Արշակ Կարապետյանի առաջարկը լուրջ արձագանք էր գտնելու ինչպես Սփյուռքի հայության, այնպես էլ Հայաստանի Հանրապետության քաղաքացիների շրջանում։ Ի վերջո, գործող իշխանություններն իրենք էլ հասկանում են, որ իրավական ճանապարհն ամենավտանգավորն է իրենց համար, երբ ընդդիմադիր քաղաքական ուժն իրենց դեմ պայքար է մղում բացառապես միջազգային իրավունքի նորմերով։ Եվ դա է պատճառը, որ Նիկոլ Փաշինյանը հանձնարարել է իր ուժայիններին ու դատաիրավական համակարգին՝ նյութեր նախապատրաստել, փորձել տպավորություն ստեղծել, թե Արշակ Կարապետյանն իրականում հանդես է գալիս հակաօրինական առաջարկով։

«Համահայկական ճակատ» կուսակցության հիմնադիր համագումարում Արշակ Կարապետյանն առաջարկել էր Հայոց ազգային արժանապատվության տրիբունալ ստեղծել, հաշվի առնելով, որ Հայաստանի դատական համակարգը չունի բավարար չափով անկախություն, ինչպես և հնարավորություններ՝ այսօր պատժելու Նիկոլ Փաշինյանին, իսկ ստեղծվելիք տրիբունալը, որ կազմված է լինելու արտերկրի և Հայաստանի անվանի իրավաբաններից, կարող է բաց և թափանցիկ իրավական գործընթացի պայմաններում իսկապես լուրջ փաստեր ներկայացնել Նիկոլ Փաշինյանի և նրա կողմնակիցների պատասխանատվությունն արձանագրելու, սերունդների դատին ներկայացնելու համար։

Փաշինյանական իշխանության քննիչներն ու դատախազները նույնիսկ փորձում են պարզել, թե ովքեր են Հայաստանում գործող այն իրավաբանները, որոնք կարող են առնչություն ունենալ Արշակ Կարապետյանի առաջարկած Հայոց ազգային արժանապատվության տրիբունալին, ահաբեկել նրանց, ինչպես և պարզել, թե ինչ մեթոդներով են փաստահավաք առաքելություն իրականացնում։ Ի վերջո, գործող իշխանությունները հասկանում են, որ առնվազն արտերկրում բնակվող հայ իրավաբանների դեմ ռեպրեսիվ մեթոդներով դժվար է պայքարել, բայց Հայաստանում, որը վաղուց այլևս վերածվել է ոստիկանական պետության, հաշվի չեն առնում ոչ մարդու վաստակը, ոչ էլ նրա իրավաբանական հմտությունները, միանգամից բռնաճնշումների են ենթարկում, ընդհուպ՝ ֆիզիկական հաշվեհարդար տեսնում։

Անշուշտ, Արշակ Կարապետյանը հաշվարկել է նաև նման հնարավորությունը, և առայժմ չեն հրապարակվում այդ տրիբունալի անդամների անունները, բայց առաջիկայում դրանք հրապարակվելու են այնպես, որ այլևս գործող իշխանությունները հնարավորություն չունենան վտանգ ներկայացնելու տրիբունալին մասնակցող իրավաբանների, մասնագետների, պատմաբանների և այլ հեղինակություն վայելող անձանց համար։
