«Նարեկ Սամսոնյանի և Վազգեն Սաղաթելյանի կարգավիճակը բավարարում է ոչ միայն քաղաքական բանտարկյալի, այլև խղճի բանտարկյալի չափանիշներին». «Փաստ»

«Փաստ» օրաթերթը գրում է.

Քաղաքական իրավունքների հայկական կենտրոնն ուսումնասիրել է «Իմնեմնիմի» փոդքաստի վարողներ Նարեկ Սամսոնյանի և Վազգեն Սաղաթել յանի նկատմամբ մեղադրանքը և երեկ հրապարակել է իր եզրակացությունը, այն է՝ նրանց հետապնդումը կրում է քաղաքական բնույթ՝ իրավական հիմքի բացակայության պատճառով։ Նրանք մեղադրվում են «խուլիգանություն» կատարելու մեջ՝ փոդքասթի թողարկման ընթացքում ՀՀ վարչապետին և իր կուսակիցներին ուղղված հայհոյանքների համար։ Քրեական գործով փոդքասթերներին սպառնում է 5 տարի ազատազրկում։ ՔԻՀԿ ամփոփ տեղեկանքում նշվում է, որ փոդքասթի վարողները նախապես զգուշացրել էին, որ ընթացիկ հատվածում կիրառելու են հայհոյանքներ, իսկ տեսանյութի քննարկվող հատվածը կրում էր 18+ նշումը։

Հաշվի առնելով, որ վիրավորանքը և ծանր վիրավորանքը ՀՀ-ում ապաքրեականացված են՝ փոդքասթերներ Նարեկ Սամսոնյանը և Վազգեն Սաղաթել յանը, լինելով կալանավորված, փաստացի կրում են ազատազրկման պատիժ՝ քրեական օրենքով չնախատեսված արարքի համար։ Այս հանգամանքները ինքնին նշանակում են, որ վերջիններիս կարգավիճակը բավարարում է ոչ միայն քաղաքական բանտարկյալի, այլև խղճի բանտարկյալի չափանիշներին։ Ն. Սամսոնյանի և Վ. Սաղաթել յանի նկատմամբ «առցանց խուլիգանության» քրեական մեղադրանքը, ըստ բովանդակության, նույնանում է վարչապետին ուղղված վիրավորանքի համար քրեական հետապնդման հետ։ Բլոգերների դեմ հարուցված քրեական գործը, որի շրջանակներում նրանք գտնվում են անազատության մեջ, պայմանավորված է բացառապես նրանց օգտագործած թիրախային արտահայտություններով և չի կարող մեկնաբանվել որպես «խուլիգանություն»։

«Փաստորեն Հայաստանում վիրավորանքի «կրկնակի ապաքրեականացումը» կրում է ձևական բնույթ և դրա «փաստացի» հանցակազմը շարունակում է գործել՝ տվյալ դեպքում քողարկված որպես «առցանց խուլիգանություն»։ Իրավունքի անհամաչափ սահմանափակումը առկա է, անկախ այն հանգամանքից, թե այն պայմանավորված է ձևական առումով գործող օրենքով, իրավապահների գործելաոճով, թե օրենքի կամայական մեկնաբանությամբ»,-գրված է զեկույցի մեջ։

Ըստ այդմ, Քաղաքական իրավունքների հայկական կենտրոնը կոչ է անում քրեական վարույթում ներգրավված բոլոր մարմիններին՝ կալանքից անհապաղ ազատ արձակել Նարեկ Սամսոնյանին և Վազգեն Սաղաթել յանին, դադարեցնել նրանց նկատմամբ իրականացվող իրավականորեն անհիմն քրեական հետապնդումը, Նարեկ Սամսոնյանին և Վազգեն Սաղաթել յանին տրամադրել արդար և համարժեք փոխհատուցում՝ ազատությունից ոչ իրավաչափ հիմքերով զրկված լինելու պատճառով, ձեռնպահ մնալ ապագայում քրեական օրենքի կամայական մեկնաբանություններից և համանման քրեական գործերի հարուցումից։
