Ինչպես փչացրին ՍԴ դատավորի ընտրությունը

Ազգային ժողովը երեկ չկարողացավ Սահմանադրական դատարանի դատավոր ընտրել, առաջադրված թեկնածուն՝ դատավոր Դավիթ Բալայանը, ստացել էր 32 կողմ ձայն, այն էլ միայն ընդդիմությունից։ Իշխող «Քաղաքացիական պայմանագիրն» ամբողջ կազմով չէր մասնակցել քվեարկությանը, ընդհուպ նույնիսկ կասկածներ էին հնչել դատավորի բարեվարքության վերաբերյալ, մինչդեռ կոռուպցիայի կանխարգելման հանձնաժողովը թերևս Դավիթ Բալայանի դեպքում լիակատար դրական եզրակացություն էր տվել, իսկ շատ այլ դատավորների պարագայում, երբ անկախ հանձնաժողովը նման եզրակացություն չէր տվել, «Քաղպայմանագիրն» այդպիսի անձանց տարբեր պաշտոնների էր նշանակել։

Բալայանը դատական համակարգի եզակի անկախ դատավորներից մեկն է, որը քննադատություն էր հնչեցրել, երբ 2019 թվականին Փաշինյանական իշխանությունը փակել էր դատարանների մուտքերը, նաև պարբերաբար հանդես է գալիս գործող իշխանությունների որևէ ապօրինության քննադատությամբ։ Թերևս, հենց սա է հիմնական պատճառը, որ Դավիթ Բալայանին չընտրեցին ՍԴ դատավոր։

Օրենսդրությամբ այդ մեկ տեղը պատկանում է դատավորների ընդհանուր ժողովին, որն էլ երկու թեկնածուներից ընտրել էր Դավիթ Բալայանի թեկնածությունը։ Մյուս թեկնածուն ԲԴԽ նախկին անդամ Դավիթ Խաչատուրյանն էր, որն էլ հենց իշխանության սրտի թեկնածուն էր։

Խաչատուրյանը սորոսականի համարում ունի և դատավորների շրջանում մեծ հեղինակություն չի վայելում։ Դատավորների ընդհանուր ժողովն այժմ ստիպված է նոր թեկնածու առաջադրել։ Վարչախումբը վստահաբար, չի ընկրկելու, և ՍԴ դատավոր կընտրի միայն նրան, ով իրեն հավատարմության երդում կտա։
