Կարեն Վանեցյանը գտնվում է ազատության մեջ․ փաստաբանական խումբ

Գործարար Կարեն Վանեցյանի փաստաբանական խումբը հայտարարություն է տարածել, որում ասվում է․

«Կարեն Վանեցյանը գտնվում է ազատության մեջ։

Նկատի ունենալով այն հանգամանքը, որ միջազգային խոշոր գործարար մեր Վստահորդ Կարեն Վանեցյանի նկատմամբ հարուցված քրեական հետապնդումը վարույթն իրականացնողի (քննչական կոմիտե) և գլխավոր դատախազության կողմից հանրայնացվելու արդյունքում ստացել է մեծ հնչեղություն, իսկ այսօր ԶԼՄ-ների կողմից տարածվել է տեղեկատվություն Կարեն Վանեցյանի ՌԴ-ում ձերբակալման վերաբերյալ՝ անհրաժեշտ ենք համարում հայտնել հետևյալը․

1) Կարեն Վանեցյանը գտնվում է ազատության մեջ և տարածվող լուրերն այն մասին, որ վերջինս անազատության մեջ է՝ չեն համապատասխանում իրականությանը:

2) Կարեն Ռոբերտի Վանեցյանը 2021 թվականի սեպտեմբերի 14-ից մինչ օրս չի եղել Հայաստանի Հանրապետությունում, նախքան այդ երկարատև տևողությամբ ՀՀ-ում առհասարակ չի գտնվել հետևաբար վերջինս մշտապես չի բնակվում ՀՀ-ում, զբաղվում է խոշոր ձեռնարկատիրական գործունեությամբ մի շարք երկրներում, այդ թվում ՌԴ-ում:

3) Կարեն Վանեցյանի նկատմամբ հանրային քրեական հետապնդում հարուցելու մասին դատախազի 2023 թվականի նոյեմբերի 1-ի որոշմամբ մեղադրանքը վերաբերում է փողերի լվացմանը, սակայն դա ընդամենը դատախազության և քննչական մարմնի ունեցած վարկածն է: Իսկ վարկածը որպեսզի իրապես դառնա մեղադրանք՝ պետք է լինեն դրա մասին վկայող, կամ ավելի հստակ՝ փաստող տվյալներ: Սույն դեպքում Կարեն Վանեցյանին վերագրվում են գործողություններ, որոնց հետ կամ ինքն առհասարակ առնչություն չունի ոչ տեսականորեն և ոչ էլ գործնական իմաստով, կամ ընդհանուր բնույթի գործողություններ են, որոնց առնչությունը քրեական օրենսգրքին կրկին բացակայում է։

4) Կարեն Վանեցյանի նկատմամբ կալանքը որպես խափանման միջոց կիրառելու ակնհայտ անհիմն, ընթացակարգային և նյութական բազմաթիվ խախտումներով «որոշումը» բողոքարկվել է Վճռաբեկ դատարան, հետևաբար օրինական ուժի մեջ չի մտել:
