Օրենքն ու իրավունքը զոհաբերվել են Չալաբյանի ազատությունը սահմանափակելու նպատակին․ «Փաստ»

«Փաստ» օրաթերթը գրում է.

Ոչ մեկ անգամ առիթ ունեցել ենք նշել, որ հասարակական-քաղաքական գործիչ, «Հայաքվե» նախաձեռնության համակարգող Ավետիք Չալաբյանի դեմ գործը բառացիորեն «կարված» է և ունի բացառապես քաղաքական բնույթ՝ նպատակ ունենալով նրան հեռու պահել քաղաքական գործընթացներից: Երեկ այդ մասին խոսեց նաև Չալաբյանը: «Կարիք չկա ասելու, թե որքան աբսուրդային է իմ դեմ դատական գործը և հատկապես կայացված դատավճիռը։ Առաջին իսկ օրվանից այն եղել է զուտ քաղաքական, և այդ դատավճիռը նույնպես զուտ քաղաքական նպատակ ունի»,-ասաց նա՝ անդրադառնալով իշխանության «սրտի դատավոր» Մնացական Մարտիրոսյանի՝ իր վերաբերյալ կայացրած որոշմանը:

Չալաբյանը նաև նշեց, որ այս քրեական գործի նպատակն ի սկզբանե եղել է վարկաբեկել իրեն և սահմանափակել իր ազատությունը. «Եվ օրենքն ու իրավունքը զոհաբերվել են այդ նպատակին»։ Ի սկզբանե Չալաբյանի պաշտպանները նշել էին, որ այս որոշումն անպայման բողոքարկվելու է: Երեկ փաստաբան Վարազդատ Հարությունյանը նշեց, որ առնվազն որոշման եզրափակիչ մասը վերացակն է ու ընդհանրական: «Այս պահին դատավճիռն օրինական ուժի մեջ չի մտել, ըստ այդմ՝ որևէ սահմանափակում չկա պարոն Չալաբյանի գործունեության մասով։ Բայց դատավճռի եզրափակիչ մասը, որը մենք ստացել ենք, հրապարակված մասը բավական վերացական է եւ ընդհանրական։

Ինչո՞ւ, որովհետև դատավճռի եզրափակիչ մասում ասվում է՝ «սահմանափակել ազատությունը, մասնավորապես, կազմակերպել կամ մասնակցել հավաքներին, ինչպես նաեւ հանրային միջոցառումներին»։ Հիմա մենք այդ մասով էլ հարցեր ունենք, որովհետև հանրային միջոցառումներ հասկացությունը բավական լայն է, եւ իր մեջ ենթադրում է բազմապիսի հավաքներ, նաեւ ոչ քաղաքական բնույթի»,- ասաց նա։
