Ուղիղ հրահանգների նոր «սերիան»․ «Փաստ»

«Փաստ» օրաթերթը գրում է.

Ինչի՞ մասին էր ՀՀ վարչապետի պաշտոնն զբաղեցնող Նիկոլ Փաշինյանի երեկվա ճառը՝ ԱԺ ամբիոնից: Նկատի ունենք նրա ելույթի հատկապես դատ-դատաստանին, դատարաններին, դատավարությունների ձգձգումներին վերաբերող հատվածը, որը փաստացի կառավարության նիստերից մեկում սկանդալային հրահանգ-ելույթի շարունակությունն էր: Մեծ հաշվով, դա գրեթե անսքող, այսինքն՝ վատ քողարկված, տո՛, կոնկրետ հատվածներում ոչ էլ քողարկված հրահանգ էր առ դատավորները: Նիկոլ Փաշինյանին ակնհայտորեն դուր է գալիս այն հանգամանքը, որ ինքը, չունենալով դրա իրավունքը, չարաշահելով զբաղեցրած պաշտոնը, հրահանգներ է իջեցնում դատական համակարգին, դատավորներին, թե ինչն ինչպես անեն, ում դատեն, ում չդատեն, ինչ արագությամբ դատեն, ինչպիսի դատավճիռներ կայացնեն:

Օրինակ՝ նա ասում է, ավելի ճիշտ, կներեք, մուննաթ է գալիս, թե՝«աղմուկ-աղաղակով, դիմակ-հրազենով կասկածյալների ձերբակալությունների տեսարանները և ապա այն փաստը, որ մի քանի օրից այդ նույն կասկածյալներին մարդիկ տեսնում են սրճարաններում սուրճ վայելելիս, կոգնիտիվ դիսոնանս է առաջացնում հանրային գիտակցության մեջ»: Չէ, հասկանում ենք, որ այդ դիսոնանսը հասարակության շրջանում չէ, այլ ինքն է նեղվում, որ իր իսկ հրահանգով ու իրեն դուր գալու համար արված այդ «աղմուկ-աղաղակով ձերբակալությունները», այդ «մասկի շոուները», այդ «ասֆալտին փռելը», այդ ամենը հատուկ նկարելն ու տարածելը կարճաժամկետ էֆեկտ են ունենում, և հասարակությունը արագ տեսնում է, թե ինչ փուչիկ գործերի հետ գործ ունենք: Մի խոսքով, պարզ է, թե ինչ էր երեկ ուզում ասել Փաշինյանը, գործնականում դատավորների վրա ճնշում էր գործադրում, թե՝ «արագ-արագ դատեք, միայն մեղադրական դատավճիռներ ընդունեք, ոչ մեկին կալանքից բաց մի թողեք»:

Դե, բանտաոստիկանական ռեժիմ է, ուրիշ ինչ պիտի անեին: Մնում է, որ եժովյան «տրոյկաներ» ներդնեն: Հա, երեկ Փաշինյանը նաև իր իշխանության ոչ վաղուցվա փառահեղ անցյալն էր հիշել: Ասաց, թե՝ 2019 թվականին դատարանների մուտքերը շրջափակել էին... «արդարադատության դռները բացելու համար»: Սա ասում է մի վարչապետ, որի պաշտոնավարման շրջանում բանտում հացադուլից քննության տակ գտնվող մարդ է մահացել, դատարանի դահլիճում շինծու գործով մեղադրվող է մահացել, կամ նրան հասցրել են մահվան: Սա ասում է մի վարչապետ, որի պաշտոնավարման շրջանում «նորմա» են դարձել կամայական կալանավորումները, կալանքով խոշտանգելը, վատառողջ մարդկանց նպատակային կերպով բանտային պայմաններում պահելը...

Իսկ ինչ վերաբերում է 2019-ին դատարանների շրջափակմանը, ապա դա ոչ թե «արդարադատության դռները բացելու» ակցիա էր, այլ դատական համակարգը գործադիր իշխանության կրնկի տակ կոխելու քաղաքական ակտ: Դա իշխանության թևերից մեկը զավթելու, ըստ էության, իշխանազավթում իրականացնելու նպատակ հետապնդող վայրագ գործողություն էր՝ իր հետագա ծանր դրսևորումներով...
