«Հայաստանի սոցիալ-տնտեսական իրավիճակին համապատասխան»՝ կավելանա պետական տուրքերի չափը. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Արդարադատության նախարարությունն առաջարկում է լրացումներ և փոփոխություններ կատարել «Պետական տուրքի մասին» օրենքում և լրացումներ՝ «Քաղաքացիական դատավարության» օրենսգրքում: Ներկայացված նախագծով առաջարկվում է փոփոխել պետական տուրքերի չափը: Առաջին՝ առաջարկվում է պայմանագրերի անվավերության պահանջ ներկայացնելու դեպքում տուրքը գանձել պայմանագրի գնի հիման վրա հաշվարկվող դրույքաչափով՝ հիմք ընդունելով դրամական պահանջների համար սահմանված տոկոսային, առավելագույն և նվազագույն չափերը:

Ներկայումս գործող ընդհանուր կանոնի համաձայն՝ տուրքի չափը հաշվարկվում է հիմք ընդունելով այն հանգամանքը, թե արդյոք դատարան ներկայացվող պահանջը բնույթով դրամական է, թե ոչ դրամական: Երկրորդ՝ ակնհայտ անհիմն հայցադիմում ներկայացնելու հիմքով արագացված դատաքննություն կիրառելու և հայցը մերժելու դեպքում լրացուցիչ տուրք գանձել՝ նախապես վճարված տուրքի կրկնակիի չափով: Նշվում է, որ անձինք հաճախ առանց իրավական կամ փաստական հիմքեր ունենալու արհեստական հայցադիմումներ են ներկայացնում դատարան՝ անհիմն կերպով ծանրաբեռնելով նաև դատական համակարգը:

Երրորդ՝ քաղաքացիական դատավարության օրենսգրքում նախատեսել կառուցակարգ, որի համաձայն դատարանը կունենա լիազորություն ակնհայտ անհիմն հայցադիմում ներկայացնելու դեպքում, հայցադիմումը մերժելով, անդրադառնալ լրացուցիչ տուրք գանձելու հարցին: Չորրորդ՝ քաղաքացիական դատավարության պարզեցված վարույթի կարգով քննվող դրամական պահանջի դեպքում տուրքի նվազագույն շեմը սահմանել 5000 դրամը: Հինգերորդ՝ վարչական ակտերի վիճարկման պահանջով հայցադիմումների համար սահմանված տուրքի կանոնը նախատեսել այնպես, որ այն կիրառվի դրամական պարտավորություն առաջադրող բոլոր վարչական ակտերի վիճարկման նկատմամբ:

Նախագծի ընդունման արդյունքում ակնկալվում է ապահովել Հայաստանի սոցիալտնտեսական իրավիճակին համապատասխան պետական տուրքերի չափ՝ քաղաքացիական դատավարության պարզեցված վարույթի կարգով քննվող գործերի համար, կանխել ակնհայտ անհիմն հայցադիմումների ներկայացումն առաջին ատյանի ընդհանուր իրավասության դատարաններ, սահմանել պայմանագրերի անվավերության պահանջի դեպքում դատարանի կողմից մատուցված ծառայությանը՝ գործի քննությանը և լուծմանը համապատասխան պետական տուրքի գանձումը պայմանագրի գնի չափով պայմանավորված, ինչպես նաև ապահովել դրամական պարտավորություն առաջացնող վարչական ակտերի վիճարկման դեպքում կիրառվող տուրքի միատեսակությունը:
