Աշակերտը կորցրել է աչքն ու տեսողությունը. սևանցի աշակերտի գործը ևս հասավ ՄԻԵԴ. ՀՔԱ

Ուսուցչի կողմից բռնի գործողության հետևանքով աչքը կորցրած Մեսրոպ Խաչատրյանի ներկայացուցիչները 2017 թ. հունիսի 19-ին գանգատ են ներկայացրել Մարդու իրավունքների եվրոպական դատարան: Այս մասին հայտնում է ՀՔԱ Վանաձորի գրասենյակը:

Գանգատի հիմքում Մարդու իրավունքների եվրոպական կոնվենցիայի 3-րդ հոդվածն է, որով ամրագրվում է խոշտանգումներից զերծ մնալու իրավունքը:

Սևանի ավագ դպրոցի աշակերտ Մեսրոպ Խաչատրյանի հետ դեպքը տեղի է ունեցել 2014 թ. դեկտեմբերի 9-ին: Ֆիզիկայի ուսուցչուհի Հասմիկ Մարգարյանը, փորձելով սաստել առանց իր թույլտվության տեղից վեր կացած Մեսրոպին, որը մոտեցել էր կախիչին վերարկուն հագնելու նպատակով, վեր է կացել տեղից և սպառնալով մոտեցել կախիչին ու այն հրել աշակերտի ուղղությամբ: Նրա գործողությունների արդյունքում Մեսրոպ Խաչատրյանը կորցրել է ձախ աչքը:

ՀՀ Գեղարքունիքի մարզի ընդհանուր իրավասության դատարանի 2016 թ․ ապրիլի 25-ի որոշմամբ Հասմիկ Մարգարյանը մեղադրվել է ՀՀ Քրեական օրենսգրքի 120-րդ հոդվածի 1-ին մասով (Անզգուշությամբ առողջությանը ծանր վնաս պատճառելը) նախատեսված արարք կատարելու մեջ և տուգանվել 200.000 ՀՀ դրամով: Հայցվոր կողմը նաև վնասի փոխհատուցման պահանջ էր ներկայացրել, սակայն այն մերժվել էր դատարանի կողմից: Մեկ ամիս անց վճիռը բողոքարկվել է, որի արդյունքում Վերաքննիչ դատարանը 2016 թ. հուլիսի 27-ին վնասի փոխհատուցման մասով գործն ուղարկել է առաջին ատյանի դատարան՝ նոր քննության:

Մեսրոպ Խաչատրյանի ներկայացուցիչներ, ՀՔԱ Վանաձորի գրասենյակի փաստաբաններ Անի Չատինյանն ու Արայիկ Զալյանը ՄԻԵԴ ներկայացրած գանգատով հիմնավորումներ են ներկայացրել ՄԻԵԿ 3-րդ հոդվածի խախտման մասին: Նրանք անդրադարձել են այն հանգամանքին, որ ուսուցչի գործողությունների արդյունքում Մեսրոպը ոչ միայն ֆիզիկական, այլև հոգեբանական ուժեղ ցավ է զգացել:
