«ՄՏՍ Հայաստանի» ուշագրավ պատկերացումներն «առևտրային գաղտնիքի» մասին. ի՞նչ փոխվեց մի քանի ամսում. «Փաստ»

«Փաստ» օրաթերթը գրում է.

 «ՄՏՍ Հայաստան» փակ բաժնետիրական ընկերությունը դեռևս 2023 թ. հունվարի 26-ին Հանրային ծառայությունները կարգավորող հանձնաժողով էր ներկայացրել ընկերության նկատմամբ հսկողության փոխանցումը համաձայնեցնելու հայտ, որը 2023 թ. ապրիլի 12-ին մերժվել է հանձնաժողովի կողմից: Որոշման մեջ նշվում է, որ ԲՏԱ նախարարությունը հարցը քննարկել է ՀՀ շահագրգիռ մարմինների հետ և իրեն վերապահված իրավասությունների սահմաններում առարկել է գործարքի կայացմանը։ Ընդ որում, որոշման մեջ հատուկ հղում է կատարվում օրենքի դրույթին, համաձայն որի, «գործարքի համաձայնեցումը կարող է մերժվել, եթե իրավասու մարմնի գնահատմամբ, վնասում կամ կարող է վնասել ազգային անվտանգությունը կամ պետական շահերը»:

Վերջին շրջանում նորից էին ակտիվացել տեղեկությունները, որ «ՄՏՍ Հայաստան» ՓԲԸ-ն վերստին դիմելու է ՀԾԿՀ՝ բաժնետոմսերի վաճառքի համար թույլտվություն ստանալու համար: Ավելին, մենք ունեինք հստակ տեղեկություններ, որ հայտը ներկայացվելու է նոյեմբերի սկզբին: Ըստ այդմ, «Փաստը» հոկտեմբերի 30-ին դիմել էր «ՄՏՍ Հայաստան» ընկերությանը՝ խնդրելով պատասխանել, թե որքանով է ճիշտ այդ տեղեկությունը, և ինչ փուլում է ընկերության նկատմամբ հսկողության փոխանցման գործընթացը: Նոյեմբերի 1-ին ընկերությունից ստացել ենք պատասխան, որտեղ նշվում է, որ «պահանջված տեղեկությունները (այդ թվում՝ նշված հարցերի հերքումը կամ հաստատումը) չեն կարող տրամադրվել, քանի որ դրանք հանդիսանում են «ՄՏՍ Հայաստան» ՓԲԸ-ի առևտրային գաղտնիք»: Այս պատասխանը ուշագրավ է այնքանով, որ պատասխանից ուղիղ երկու օր անց՝ նոյեմբերի 3-ին, «ՄՏՍ Հայաստանը» Հանրային ծառայությունները կարգավորող հանձնաժողով է ներկայացրել ընկերության նկատմամբ հսկողության փոխանցումը համաձայնեցնելու հայտ:

Ավելին, ՀԾԿՀ կայքում տեղադրված է նոյեմբերի 15-ի նիստի օրակարգը, ներառյալ համապատասխան որոշման նախագիծը, որով հանձնաժողովը համաձայնություն է տալու ընկերության բաժնետոմսերի 100 %-ը «Ֆեդիլքո Գրուպ Լիմիթիդ» ընկերությանը վաճառելու գործարքի կնքմանը։ Նախ՝ հետաքրքիր է, թե ինչպես է այս մի քանի ամսում վերացել «ազգային անվտանգությունը կամ պետական շահերը վնասելու» նորմը, առավել ևս, որ գնորդը նույն կազմակերպությունն է: Ի՞նչ եղավ այս մի քանի ամսում, որ ԲՏԱ նախարարությունն այս գործարքի կայացման վերաբերյալ իր իրավասությունների շրջանակում առարկություններ այլևս չունի: Մյուս կողմից՝ ի՞նչ առևտրային գաղտնիքի մասին էին իրենց պատասխանում նշել «ՄՏՍ Հայաստանի» պատասխանատուները, երբ այդ տեղեկություններն ընդամենը օրերի ընթացքում օրենքի ուժով պետք է լինեին հրապարակային:

Ի վերջո, դիմելուց ընդամենը երկու օր առաջ խնդրել էինք պատասխանել... դիմելո՞ւ են ՀԾԿՀ, թե՞ ոչ: Ինչ խոսք, ուշագրավ են «ՄՏՍ Հայաստանի» պատկերացումներն «առևտրային գաղտնիքի» մասին:
